Drug felonies top grand jury indictments
NORWICH – The Chenango County grand jury met Wednesday and handed up several indictments involving drug crimes.
At the proceedings, the District Attorney’s Office presents evidence against those they wish to prosecute and the jury decides if there is enough reasonable cause to charge a person.
Only individuals charged with a felony appear before the grand jury and all defendants are presumed innocent until proven guilty in a court of law.
• David A. Cahlill, 39, 4 Lee Ave. Norwich, was indicted for third degree criminal possession of a controlled substance, a class B felony, and first degree criminal nuisance, a class E felony.
Norwich City Police and New York State Troopers arrested Cahill and, Rachael A. Cummings, 21, also of 4 Lee Ave. on charges of trafficking heroin at their residence Sept. 30.
Police forced their way into the home at 7:50 a.m. after Cahill’s three children, ages 5, 7 and 9, boarded the bus for school.
Police allegedly seized nine individually-wrapped packages of heroin stamped with the words “Game Over” on them.
Cahill and Cummings had identical charges filed against but only Cahill has so far appeared before the grand jury.
First Assistant District Attorney Stephen Dunshee said at a prior court hearing that Cahill had past arrests in his home state of Connecticut for multiple drug-related offenses, including sale and possession. Dunshee also said Cahill’s past acts in the state included fleeing and fighting with police.
Cahill is currently at the Chenango County Correctional Facility on $50,000 cash bail. Cummings is at the facility on $25,000 cash bail. In an earlier bail hearing, District Attorney Joseph McBride said he would be open to lowering the bail if she decided to cooperate with police.
• Kevin J. Dunmire, 28, Court St. Apartment 1B, Norwich was indicted for third degree criminal possession of a controlled substance, a B class felony, and fifth degree criminal possession of a controlled substance, a D Class felony. Allegedly Dunmire had seven packages of individually wrapped crack cocaine hidden inside his mattress. Dunmire was on parole when he was charged with the current offenses.
New York State, the Division of Parole with the aid from the Norwich Police searched Dunmire’s residence at 9:13 a.m., June 30 and allegedly seized several additional drugs, including 7.1 grams of psychedelic mushrooms, six ecstasy pills, powdered cocaine in a shirt pocket, prescription anxiety medication, Alprazolam and a small amount of marijuana.
Living at the apartment with Dunmire was 25-year-year-old Heather M. Bradley, who is facing charges of third degree criminal possession of a controlled substance, seventh degree criminal possession of a controlled substance and unlawful possession of marijuana. She has not yet to come before the grand jury for indictment.
• Michael F. Dibbell, 51, New Berlin, was indicted for second degree criminal possession of marijuana, a D Class felony.
The Town of New Berlin Police Department arrested Dibbell Sept. 2 and charged with the felony level offense after confiscating 35 maturing marijuana plants from his home that produced more than a pound of the drug.
Dibbell’s property along County Route 28 was raided by the New Berlin PD and the New York State Police and he was originally charged in the case with growing cannabis, a misdemeanor.
Officers searched the 70-acre property with the aid of a helicopter and allegedly seized marijuana plants, estimated to have a street value of $25,000 to $35,000.
Police said many of the maturing plants were around 6 to 7 feet tall and were hidden among thick foliage and thorn bushes about quarter of mile into a wooded area.
He has been remanded to the Chenango County Correctional Facility in lieu of $5,000 cash bail.
• David A. Crane, 41, Henry Street, Norwich, was indicted on two counts of first degree criminal contempt, an E Class felony, after he allegedly violated an order of protection to stay away from a female victim twice in three days.
The indictment claims Crane entered the victim’s home at 8:15 p.m. Oct. 6 and subjected her to unwanted physical contact by “ pulling her hair, choking her, throwing her on a couch and holding her down.” He then allegedly return to the home three days later on Oct. 9 at 11:30 a.m., again defying the order.
The indictment included a summary of Crane’s recent criminal history which contained four previous misdemeanor criminal contempt charges over violating court orders to stay away from a victim.
On June 2, Crane pleaded guilty to second degree criminal contempt after originally being charged with assault and acting in a manner to endanger a child.
On March 18, 2008, Nov. 13, 2007 and on Nov. 16, 2006, Crane pleaded guilty to additional charges of second degree criminal contempt in separate cases after originally being charged with harassment in each. Also in each previous case, Crane was originally charged with felony first degree contempt but was allowed to plead to the reduce misdemeanor offense of second degree criminal contempt.
• Dean A. Youngs, 44, North Norwich, was indicted for aggravated driving while intoxicated and first degree aggravated unlicensed operation of a motor vehicle, both E Class felonies. Youngs was allegedly pulled over at 7:49 p.m. Aug. 22 in the Town of Pharsalia and found to have a blood alcohol level of .2 percent, more than double the .08 legal limit.
The indictment also says at the time of his arrest, Youngs’ license was already under suspension for a prior drinking and driving offense.
• Courtney N. Lugg, 23, Utica, was indicted on charges of second degree forgery and second degree possession of a forged instrument, both D Class felonies.
The indictment claims Lugg counterfeited a personal check and then signed a victim’s name to it in order to cash $562.25 at a Sherburne business.
• Justin M. Higgs, 20, Bainbridge was indicted on charges of second and third degree burglary, C and D class felonies, after he allegedly enter a residence in the Village of Bainbridge and stole a jar of loose change. He was also indicted with petit larceny, a misdemeanor.
• Edward J. Panus, 60, Afton, was indicted for fourth degree welfare fraud and first degree offering a false instrument for filing. Allegedly Panus falsified his food stamp application Oct. 30 by failing to mention he had a $10,000 savings account at Sidney Federal Credit Union. The indictment claims Panus collected $1,280 worth of benefits between October 2008 and May 2009 that he was not eligible for.
