Chenango grand jury indicts 14
NORWICH – The Chenango County grand jury met last week and indicted 14 people with felony charges.
At the proceedings, the District Attorney’s Office presents evidence against those they wish to prosecute as a felon and the jury decides if there is enough reasonable cause to charge a person.
• Three co-defendants were each indicted for third degree arson, a class C felony and fourth degree conspiracy, a misdemeanor, after they allegedly collaborated in burning down their own home.
The indictment accuses 36-year-old homeowner Kimberly Koster, her 17-year-old daughter Chelsie M. Koster and her 70-year-old father, Joseph S. Dietzman, of setting their Coventry home ablaze Aug. 13.
“The defendant did intentionally damage her dwelling by pouring gasoline inside her residence which was later set on fire by a co-defendant, causing complete loss of the residence,” stated Kimberly Koster’s indictment.
It also claimed her daughter participated in the incident “by starting a fire when she intentionally lit a match and placed it on a pile of clothes inside the residence.”
The indictment did not elaborate on Dietzman’s alleged participation in the incident. He was arrested after the Kosters were initially charged with the crime.
A number of area fire departments responded to the 10:20 p.m., Aug. 13 fire at 1636 State Highway 235 after a neighbor called 911.
Firemen found the unoccupied home engulfed in flames when they arrived. Within a few hours, fire investigators inspecting the building’s debris found evidence of foul play and contacted the Chenango County Sheriff’s Office.
• Robert V. Shenise Jr., 25, Norwich, was indicted on two counts of fourth degree grand larceny, E class felonies, fourth degree criminal possession of a weapon, fourth degree criminal mischief, aggravated driving while intoxicated and driving while intoxicated, misdemeanors.
New York State Police arrested Shenise at 3:38 p.m. Oct. 8 in the Town of Norwich after a resident complained that a pick-up truck was intentionally destroying his lawn by spinning its tires and performing other erratic maneuvers.
The indictment claimed Shenise caused more than $3,000 in damages to the yard. Shortly thereafter, Shenise was involved in a roll-over accident with the truck. He was charged with fourth degree criminal mischief and driving while intoxicated. According to the indictment, Shenise’s blood-alcohol content was more than triple the legal .08 percent limit.
The indictment also said the pick-up truck was reported stolen and that Shenise was armed with a stolen .45 caliber handgun.
• Shawna L. Franklin was indicted for third degree grand larceny, a class D felony, first and second degree falsifying business records, an E class felony and misdemeanor.
Franklin was a store manager at the Quickway in the Village of Oxford and allegedly stole $22,734 from her employer between Aug. 5 and Aug. 23.
The indictment claims she made “numerous false entries in various business documents,” in an effort to conceal her alleged crimes.
• Jennifer L. Alvarez was indicted for third degree welfare fraud, a class D felony and first degree offering a false for filing.
Alvarez allegedly filed documentation with the Chenango Department of Social Services claiming her four children still lived in her household when they did not. According to the indictment, she collected $9,915.80 in funds she was not entitled to between April 2007 and January 2008.
• Andrew J. Shutts was indicted for first degree unlicensed operation of a motor vehicle, fourth degree grand larceny, both class E felonies, driving while intoxicated and operating a motor vehicle with more than .08 percentum of alcohol in his blood, misdemeanors.
Allegedly Shutts was pulled over at 2:17 a.m., Sept. 3, along State Highway 80 in the Town of Smyrna driving a stolen truck, while intoxicated and with a revoked driver’s license.
• Alfonso S. Davis, 27, was indicted for third degree rape, third degree criminal sexual act, both class E felonies, and endangering the welfare of a child after allegedly having sexual contact with 15-year-old youth around Aug. 7.
• Jose A. Irizarry was indicted for first degree burglary, a class B felony, second degree assault, and first degree unlawful imprisonment.
According to the indictment, Irizarry broke into a home Aug. 28 in the City of Norwich armed with a knife and threatened a female victim by holding the blade to her throat before cutting her face.
• Jerry L. Stone, Jr., was indicted for aggravated driving while intoxicated, an E class felony, aggravated driving while intoxicated, driving while intoxicated and endangering the welfare of a child, misdemeanors.
Allegedly Stone was pulled over at 2:45 p.m. along State Highway 8 in the Town of New Berlin with his 8-year-old daughter in the car. The indictment claims Stone had a blood alcohol level of .29 percent, more than three times the legal limit of .08.
• Mark A. Geier was indicted for driving while intoxicated, a class D felony, after being pulled over Aug. 3, along State Highway 80 in the Town of New Berlin.
The indictment stated Geier was previously convicted of two misdemeanor DWI charges on Oct. 5, 2009 in Town of Pittsfield Court and Feb. 10, 2004 in Village of New Berlin Court.
• Robert E. Straight was indicted for third degree criminal possession of stolen property, a class D felony, and fifth degree criminal possession of stolen property, a misdemeanor, after allegedly stealing $3,865 in lottery tickets Sept. 14, 2009.
• Tammy L. Bresee was indicted on charges of third degree welfare fraud, a D class felony, and first degree offering a false instrument for filing, an E class felony.
According to the indictment, Bresee filed false documentation with the Chenango County Department of Social Services and collected $8,804.45 she was not entitled to between November 2005 and April 2009. The indictment stated that during that time, Bresee failed to report that she had found employment and continued to receive benefits.
• Calvin M. Parker was indicted for third degree criminal possession of stolen property, a class D felony, and fourth degree criminal mischief, a misdemeanor.
According to the indictment, Parker had possession of a stolen ATV worth $5,700, which he repainted and modified Aug. 4 in the Town of Otselic.
