Sex offender sent to prison after hiding Facebook and e-mail aliases
NORWICH – A convicted sex offender was sentenced to two years in state prison Friday after probation officers discovered he was hiding e-mail and social networking identities.
Domineco R. Spinella, 28, Borden Ave., pleaded guilty second degree criminal sexual act, a Class D felony, Jan. 5, 2009, admitting he had engaged in a sexual relationship with a 14-year-old girl at the time. Spinella was originally sentenced to six months in the jail, 10 years probation and was deemed a level two sex offender
Chenango Judge W. Howard Sullivan said a report from the probation department claimed Spinella was using an alias to operate a Facebook and e-mail account under an assumed name.
District Attorney Joseph McBride said the original charges did not involve using the Internet, but the plea deal forbade any online access.
Spinella was originally arrested in August 2008 in the Town of Norwich for a number of sex crimes. The charges refer to incidents of alleged molestation at the Oxford pool and another that occurred at a private residence, both concerning the same victim. According to Spinella’s original indictment, the allegations were made in the Village of Oxford between March and July in 2008.
McBride said the defendant maintained an ongoing mutual relationship with the 14-year-old girl. He also said the victim told police investigators Spinella was her “boyfriend.”
Public Defender Alan E. Gordon said Spinella was employed, had no other prior criminal record except for a misdemeanor conviction in 2002, and had lived with his parents. He also noted the original acts were consensual and did not involve violence.
However, at a previous October 2008 county court appearance, First Assistant District Attorney Stephen M. Dunshee told the court Spinella’s prior 2002 misdemeanor conviction for endangering the welfare of a child involved “similar predatory circumstances.”
Sullivan granted Spinella about a month furlough to get his finances in order after accepting a plea to the violation of probation in late December.
Sullivan again granted a request by Spinella to remain out of jail until 5 p.m. Friday evening so he could say goodbye to his son.
Spinella was sentenced to two years in prison, six years of post release supervision and will remain a registered sex offender.
