Grand jury indicts nine
NORWICH – The Chenango County grand jury met Wednesday and handed up a number of criminal indictments. At the proceeding, the District Attorney’s Office presents evidence against those they wish to prosecute. It is up to the members of the jury to decide if there is enough reasonable cause to charge a person with a felony offense.
Those indicted by the grand jury are arraigned before the county or Supreme Court judge at a later date.
The grand jury indicted nine individuals this week:
• Leonard D. Vandermark, 64, Greene, was indicted on charges of predatory sexual assault against a child, a class A-II felony, first degree rape, first degree criminal sexual act, first degree aggravated sexual abuse and first degree sexual conduct against a child. He was also indicted on one count of committing a first degree criminal sexual act, a class B felony, and one count of endangering the welfare of a child, a class A misdemeanor. The charges stem from an incident which took place in the Town of Greene on or about Sept. 20, in which Vandermark allegedly had inappropriate sexual contact with a female under the age of 13 at his residence.
• David W. Sands, 44, homeless, was indicted on charges of second degree assault, a class D felony, and third degree assault, a class A misdemeanor. The charges concern an incident which allegedly took place on North Chenango Street in the Village of Greene on Sept. 3 during which Sands allegedly struck another person with the intent to cause physical injury by means of a deadly weapon or dangerous instrument.
• Michelle G. Stolarcyk, 41, Whitney Point, was indicted on charges of driving while intoxicated, a class E felony, and resisting arrest. According to the indictment, Stolarcyk was arrested on Aug. 11 in the Town of Greene for allegedly driving while in an intoxicated state and was observed swaying while walking, speaking with a slurred voice, having bloodshot or watery eyes and having alcohol on her breath. She also allegedly attempted to prevent law enforcement from effecting an authorized arrest at the time. Stolarcyk has one previous alcohol-related conviction for driving with a blood alcohol content of .08 percent of 1 percent or more in 2008 in the Town of Barker, Broome County.
• Ashvil C. Rood, 35, Pitcher, was indicted on charges of aggravated driving while intoxicated and driving while intoxicated, both class E felonies. The charges concern an incident which occurred in the Town of Norwich on August 1 where Rood was observed swaying while walking, speaking with a slurred voice, having bloodshot or watery eyes and having alcohol on his breath.
• Stephen L. Lehr, 53, Smithville Flats, was indicted on charges of first degree aggravated unlicensed operation of a motor vehicle, operating a motor vehicle with a blood alcohol content of .08 or more and driving while intoxicated, a class A misdemeanor. The charges stem from an incident which took place on State Highway 12 in the Town of Oxford on August 2. At the time, Lehr was observed swaying while walking, speaking with a slurred voice, having bloodshot or watery eyes and having alcohol on his breath, the indictment said. Lehr has one previous alcohol-related conviction for driving while intoxicated in 2010 in the Town of Homer, Cortland County.
• Todd M. Park, 42, North Norwich , was indicted on charges of aggravated driving while intoxicated and driving while intoxicated, both class E felonies. The charges concern an incident which took place on State Highway 12 in the Town of North Norwich. According to the indictment, Park had a blood alcohol content of .29 of 1 percent at the time of his arrest. Park has two previous alcohol-related convictions; one for driving while ability impaired in 2002 in the Town of Mentz, Cayuga County, the other for driving while intoxicated in 2006 in the Town of Oneonta, Otsego County.
• Roderic R. Williams, 44, Norwich, was indicted on charges of driving while intoxicated, a class E felony, two counts of second degree reckless endangerment, third degree aggravated unlicensed operation of a motor vehicle and misdemeanor counts of reckless driving and resisting arrest. According to the indictment, Williams allegedly engaged in conduct which created a substantial risk of serious physical injury to civilians and law enforcement officers. During the incident, Williams was allegedly traveling on his motorcycle at a high rate of speed, 85 miles per hour, veering toward several oncoming vehicles and causing them to exit the roadway to prevent a collision while traveling on State Highway 12 in the towns of Norwich, Oxford and Greene. Williams has one previous alcohol-related conviction for driving while intoxicated in 2007 in Susquehanna County.
• Sonya R. Thomas, 35, Norwich, was indicted on charges of third degree grand larceny, a class D felony, and petit larceny, a class A misdemeanor. According to the indictment, Thomas allegedly stole approximately $5,000 from a cash register at her place of employment in the Town of Norwich.
• Shawnery J. Middleton, 36, Cazenovia, was indicted on charges of aggravated driving while intoxicated and driving while intoxicated, both class E felonies. He was arrested following a traffic stop on County Road 13 in the Town of Lincklaen and, according to the indictment, had a blood alcohol content of .21 of 1 percent. Middleton has one previous alcohol-related conviction in 2009 in the Town of Clay, Onondaga County.
