Pierce found guilty of second degree burglary
NORWICH – A second man accused in an attempted Beebe Avenue robbery that occurred in August of 2010 has been found guilty by a Chenango County jury. The verdict – passed down by jurors after less than an hour of deliberations yesterday – finds defendant Anthony Pierce guilty of second degree burglary, a class C felony.
Just last week, Pierce’s co-defendant, Daniel Sabines, was found guilty of the same charge. Both are scheduled to be sentenced at a later date.
According to prosecutors, the two would-be thieves – under the pretense of going door-to-door collecting signatures for a political petition – unlawfully entered a 22 Beebe Ave. residence on Aug. 16, 2010. When unexpectedly confronted by the home’s owner, Sabines fled through a back door. Pierce is alleged to have exited the home from a second floor front window, and was not seen by the homeowner.
District Attorney Joseph McBride called the verdict a just one and wished to thank the members of the jury for their service, as well as the Norwich City Police Department for its efforts. The officers involved in the arrest of Sabines and Pierce – in addition to the subsequent investigation – did “an outstanding job,” added McBride.
Although one witness – a nearby construction worker who saw a man exit the second floor window – was unable to positively identify Pierce in court, the prosecution had enough circumstantial evidence linking him to the crime to convince jurors of his guilt. And while no property was actually taken from the residence, the prosecution was able to prove – beyond a reasonable doubt – Pierce and Sabines’ intent to commit a crime.
According to evidence presented by the district attorney, Pierce and Sabines were seen together prior to the attempted burglary and in the immediate area of 22 Beebe Ave. A text message from Sabines to Pierce, received at 1:11 p.m., was also introduced as evidence. At that time, Pierce was already in police custody, according to the district attorney.
“The verdict was fantastic,” said McBride, who added the district attorney’s office and local law enforcement, as well as witnesses and members of the community, “do a lot of hard work” to ensure “justice is done.”
