Convicted burglar faces prison time for alleged parole violation
NORWICH – A Norwich man accused in 2010 of breaking into a woman’s home, stealing her underwear, committing sexual acts with the clothing and posting images of the victim and her garments online has violated the terms of his interim probation and could be sentenced to 2 1/3 to 7 years in state prison as a result.
Joshua Derouchie, 22, of Norwich, appeared before Judge W. Howard Sullivan in Chenango County Court Tuesday following his arrest on an active warrant for allegedly violating the conditions of his probation. According to the district attorney’s office, it’s alleged that Derouchie – in violation of the terms of his probation – visited pornographic sites online, as well as posted pornographic material for others to view.
In 2010, Derouchie was charged with two counts of second degree burglary and one count of third degree burglary, all felonies. He was convicted of the third degree burglary charge in 2010 and subsequently offered a period of interim probation.
Derouchie, said District Attorney Joseph McBride, had been “given an opportunity” to prove his behavior in 2010 was “an aberration.” Unfortunately, he added, “this does not appear to be the case.”
The victim’s privacy and safety, said McBride, is also an issue, who asked Judge Sullivan to remand Derouchie to the Chenango County Correctional Facility until sentencing to “give the victims” an opportunity to be heard.
Derouchie’s attorney, Frank Revoir, said the probation violation had been brought to his attention Tuesday morning, having only a brief opportunity to discuss the matter with his client. Revoir will now have a little over two weeks to do so, as well as conducting any investigations or filing any motions on Derouchie’s behalf, according to Judge Sullivan.
Derouchie’s sentencing has been scheduled for 11:30 a.m. on Jan. 20.
