Seventeen indicted by Chenango grand jury

NORWICH – The Chenango County grand jury met Wednesday and handed up a number of criminal indictments. At the proceeding, the District Attorney’s Office presents evidence against those they wish to prosecute. It is up to the jury to decide if there is enough reasonable cause to charge a person with a felony offense.
Those indicted by the grand jury are arraigned before the county or Supreme Court judge at a later date.
The grand jury indicted 17 people:

• Joshua W. Quinn, 19, and John W. Quinn, both of Sherburne, were indicted on two charges of third degree criminal possession of a controlled substance, a class B felony, one count of fifth degree criminal possession of a controlled substance, a class D felony, and one count of seventh degree criminal possession of a controlled substance, a class A misdemeanor. It’s alleged that the Quinns, acting in concert, did knowingly and unlawfully possess approximately 19 grams of the narcotic Dihydrocodeineone – with Acetaminophen – on or about November 12 in the Town of Norwich.

• Joshua A. Paine, 20, Guilford, was indicted on two counts of second degree burglary, a class C felony, and one count of third degree burglary, a class D felony, following three separate incidents that occurred on or about Oct. 16, Nov. 29 and Dec. 6 at two separate locations in the Town of Guilford. It’s alleged that Paine, in concert with another individual, did knowingly enter and remain unlawfully with the intent to commit a crime at a pair of Guilford residences located on County Road 35. It’s also alleged that Paine did commit the crime of larceny, stealing a 1939 Cherry Valley School class ring, cash and several antique items.

• Kenneth D. Peer, 30, South New Berlin, was indicted on a charge of first degree promoting prison contraband. It’s alleged that, on or about Oct. 18, Peer – in concert with another – did knowingly and unlawfully introduce a dangerous contraband, the narcotic Hydrocodone, into the Chenango County Correctional Facility.

• Travis M. Vanvalkenburgh, 16, and Matthew J. Devaul, 16, both of Colesville, were indicted on four counts of second degree burglary, a class C felony, and one count of third degree burglary, a class D felony, following five separate incidents that occurred on or about Oct. 29, Nov. 18 and Nov. 20. It’s alleged that Vanvalkenburgh and Devaul, acting in concert, did knowingly enter and unlawfully remain with the intent to commit a crime at five separate residences located on County Road 26 and State Highway 7 in the Town of Afton. It’s also alleged that the pair did commit the crime of larceny, stealing copper pipe; an E-machine computer, monitor, router, HP printer and personal papers; a Makita cordless drill with case and accessories, toolbox and tools, and a belt sander; a flat-screen television set, U.S. currency, fishing poles, a typewriter, magazines, a wheelbarrow and other assorted items.

• Dustin W. Boyles, 26, Norwich, was indicted on charges of second degree assault, a class D felony, and third degree assault, a class A misdemeanor, following an incident that occurred on or about Sept. 2 in the Town of Norwich. It’s alleged that Boyles, with intent to cause serious physical injury to another person, punched a Valley Ridge Center for Intensive Treatment employee in the head, face and back causing Zygomatic and lumbar spine fractures.

• Charles D. Fuller, 51, Hartwick, was indicted on one count of failure to register as a sex offender, a class E felony, after he allegedly failed to notify the Division of Criminal Justice Service of a change of address within the required ten calendar days. It’s alleged that Fuller, in April, moved from his 15 Division St., Norwich residence to 4001 County Highway 11, Cooperstown and, as of Sept. 12, had not registered with the Division of Criminal Justice Service’s Sex Offender Unit.

• Keith S. Blackwell, 23, Norwich, was indicted on one count of first degree criminal contempt, a class E felony. It’s alleged that Blackwell, on or about Dec. 21, violated a duly served court order of protection issued by the Norwich City Court by striking the subject of the order of protection in the face.

• Christopher L. Prosser, 35, Norwich, was indicted on one count of failure to register as a sex offender, a class E felony. It’s alleged that Prosser, on or about Oct. 15, created a Facebook account, actively logged into and participated in that account, and failed to notify the Division of Criminal Justice Service’s Sex Offender Unit – or the Chenango County Sheriff’s Office – of the Internet account or his Internet identifier.

• Samuel A. Muir, Jr., 61, Afton, was indicted on four counts of third degree criminal possession of a controlled substance, a class B felony. It’s alleged that Muir, on or about Sept. 30, knowingly and unlawfully possessed with the intent to sell the narcotics cocaine and Dihydrocodeineone – with Acetaminophen – in the Town of Afton. Muir allegedly had in his possession approximately 28 grams of cocaine and 31 grams of Dihydrocodeineone at the time of his arrest.

• Scott A. Yost, 29, Bainbridge, was indicted on one count of first degree reckless endangerment, driving while intoxicated, a class E felony, operation of a motor vehicle with a blood alcohol content of .08 of 1 percent or higher and third degree aggravated unlicensed operation of a motor vehicle. It’s alleged that Yost, on or about Dec. 2, recklessly engaged in conduct which created a grave risk of death for another person following a motor vehicle accident on State Highway 206 in the Town of Bainbridge. Yost was allegedly driving an estimated 85 miles per hour while in an intoxicated condition when he crashed into a tree, thereby creating a grave risk of death for his three children, ages four, three and two.

• Dale W. Brooks, 44, Afton, was indicted on one count of third degree grand larceny, a class D felony, and one count of petit larceny, a class A misdemeanor. It’s alleged that Brooks, during the periods of March 12, 2007 to July 15, 2007; July 8, 2008 to Dec. 27, 2009 and July 6, 2010 to July 18, 2010, did knowingly steal more than $10,000 from the New York State Department of Labor and received unemployment compensation he was not entitled to at three separate residences while gainfully employed at T. A. Douglas Associates, Inc. in Binghamton.

• David L. Anderson, 45, Norwich, was charged with one count of first degree aggravated unlicensed operation of a motor vehicle, a class E felony, operation of a motor vehicle with a blood alcohol content of .08 of 1 percent or higher and driving while intoxicated, a class A misdemeanor. It’s alleged that Anderson, on or about Nov. 5 on County Road 32 in the Town of Norwich, operated a 1993 Honda motorcycle bearing no registration while his ability to operate said vehicle was impaired by alcohol. Anderson was allegedly observed swaying as he walked, speaking in a slurred voice, having bloodshot or watery eyes, as well as breath smelling strongly of alcohol at the time of his arrest.

• Samuel M. Pertilla, 57, Norwich, was indicted on charges of driving while intoxicated and operation of a motor vehicle with a blood alcohol content of .08 of 1 percent or higher, both class E felonies. It’s alleged that Pertilla, on or about Nov. 20, was observed swaying as he walked, speaking in a slurred voice, having bloodshot or watery eyes, as well as breath smelling strongly of alcohol following a traffic stop on State Highway 12 in the Town of Norwich. Pertilla has a previous DWI conviction from December of 2003, handed down by the Chenango County Court.

• Ray A. Glover, 33, Norwich, was indicted on charges of driving while intoxicated and operation of a motor vehicle with a blood alcohol content of .08 of 1 percent or higher, both class E felonies, and second degree aggravated unlicensed operation of a motor vehicle. It’s alleged that Glover, on or about Nov. 18, was observed swaying as he walked, speaking in a slurred voice, having bloodshot or watery eyes, as well as breath smelling strongly of alcohol following a traffic stop on East Main Street in the City of Norwich. Glover has a previous DWI conviction from October of 2006, handed down by the Bradford County, Pennsylvania Court of Common Pleas.

• Brandon M. Peckham, 19, Greene, was indicted on charges of second degree assault, a class D felony, third degree criminal mischief, a class E felony, driving while intoxicated and resisting arrest, both class A misdemeanors. It’s alleged that Peckham, on or about Nov. 29, acted with intent to prevent a police officer in the course of performing a lawful duty and did cause physical injury to said officer. In addition, it’s alleged that Peckham did intentionally kick out a window of a Norwich PD vehicle, resulting in damages of approximately $1,200.
