Five appear in county court, one remanded on $25,000 bail
NORWICH – Five individuals charged with a variety of felony and misdemeanor crimes appeared in court Monday, one of whom was remanded to the Chenango County Correctional Facility after admitting he would test positive for an illegal substance if tested by the court.
• Beau W. Cerniglia, 26, of Tennessee, was remanded to the Chenango County Correctional Facility on $25,000 cash bail after he admitted to Judge W. Howard Sullivan he would test positive for marijuana if tested for illegal substances.
In March, Cerniglia was indicted on two counts of first degree reckless endangerment, a class D felony, as well as two counts of second degree reckless endangerment, an A misdemeanor.
It’s alleged that Cerniglia, on or about Jan. 23, 2012, engaged in conduct which created a grave risk of death – and a substantial risk of injury – to another, travelling at an imprudent rate of speed and passing through a pair of stop signs, at the intersection of Birdsall and Clinton streets, and Silver and Mitchell streets, in the City of Norwich.
Cerniglia, formerly of Greene, has been living with his parents in Tennessee and travelling to Norwich for his scheduled court appearances. He will re-appear in court at a later date.
• Dustin C. Freeman, 24, of Oxford, admitted to violating the terms of his probation, although his sentencing was postponed to a later date.
It’s alleged that Freeman, who was placed on probation on April 25, 2011 for one count of fourth degree grand larceny, did willfully and intentionally violate the terms of his probation by failing to complete the county’s Treatment Court program, as well as testing positive for cocaine on two occasions, in December of 2011 and March of 2012. He will re-appear in court at a later date.
• John T. Winn, 25, of Bainbridge, was sentenced to five years probation and must successfully complete the county’s Treatment Court program after he pleaded guilty to charges of third degree criminal possession of a controlled substance, a class B felony, and DWAI – operation of a motor vehicle while impaired by drugs – a class E felony.
In April, Winn was indicted on charges of third degree criminal possession of a controlled substance, a class B felony, fifth degree criminal possession of a controlled substance, a class D felony, and seventh degree criminal possession of a controlled substance, a class A misdemeanor.
It was alleged that Winn, on or about Nov. 28, 2011, in the Town of Afton, did knowingly and unlawfully possess 115 glassine packets of the narcotic heroin, with the intent to sell.
• Vanessa S. Furgison, 24, of Norwich, was sentenced to one to three years in state prison, to be served as parole supervision at the Willard Drug Treatment Center, after she admitted to violating the terms of her probation.
It’s alleged that Furgison, who was placed on parole on Jan. 20, 2012, did willfully and intentionally violate the terms of her probation, failing to contact the court with a current address and testing positive for amphetamines on May 1. On April 24, Furgison allegedly admitted to smoking marijuana.
• Daniel B. Pace, 53, Ilion, pleaded not guilty to charges of third degree burglary, a class D felony, and petit larceny, a class A misdemeanor.
Pace is currently out on $5,000 cash bail, although Chenango County Assistant District Attorney Stephen Dunshee asked Judge Sullivan to admonish the defendant that – if he were to fail to make any future appearances in court – he would be remanded to the Chenango County Correctional Facility.
According to Dunshee, Pace has three prior no-shows at court; 69 prior arrests; and 45 prior convictions.
Said Sullivan, addressing Pace, “What happens between now and the ultimate disposition of this case could effect that disposition.”
Pace will re-appear in court at a later date.
