Charges dismissed in grand larceny case

NORWICH – The case against accused felon Shawna Franklin was dismissed in county court Tuesday after a key witness for the prosecution was unavailable to testify.
Franklin, 27, of Oxford, was indicted by a Chenango County grand jury in October of 2010, charged with third degree grand larceny – a class D felony – as well as first and second degree falsifying business records, an E felony and class A misdemeanor, respectively.
According to the indictment, Franklin, as a store manager at the Village of Oxford Quickway, had stolen more than $22,000 from her employer between Aug. 5 and Aug. 23. The indictment went on to state that she made “numerous false entries in various business documents” in an effort to conceal the alleged crime.
A trial, scheduled to begin yesterday following jury selection, was dismissed, and there will be no further prosecution against Franklin as the case is now sealed.
Said Chenango County District Attorney Joseph McBride, “An auditor in the investigation has moved away and because he was not available, we were not able to move forward ... we could not prove the case without that witness.”
Attempts to contact Franklin were unsuccessful prior to deadline.
