Grand jury indicts 11

NORWICH – The Chenango County grand jury met Wednesday and handed up a number of criminal indictments. At the proceeding, the Chenango County District Attorney’s Office presents evidence against those they wish to prosecute. It is up to the jury to decide if there is enough reasonable cause to charge a person with a felony offense.
Those indicted by the grand jury are arraigned before the county or Supreme Court judge at a later date.
The grand jury indicted 11 individuals this week:
• Henry W. Hemsley, 73, Norwich, was indicted on charges of second degree criminal possession of marijuana, a class D felony; six counts of third degree criminal possession of a weapon, a class D felony; and seven counts of fourth degree criminal possession of a weapon, a class A misdemeanor.
It’s alleged that Hemsley, on or about Sept. 7 in the Town of Norwich, was found to be in possession of 45 marijuana plants with an aggregate weight of more than 16 ounces, a felony, in addition to two fully automatic 7.62 caliber AK47 machine guns; three fully automatic 5.56 caliber Colt M16 machine guns; a .22 caliber Marlin handgun; a .44 caliber Vietnam Commemorative revolver; a semi-automatic .45 caliber Colt Model 1911 handgun; a .41 caliber Smith & Wesson revolver; a semi-automatic 9MM Taurus handgun; a .22 caliber Dan Wesson revolver; and a .22 caliber Ruger Mark II revolver.
The charges stem from a September search of Hemsley’s County Road 32 residence by the Chenango County Sheriff’s Office and is not the first time Hemsley has faced similar charges. In August of 2008, Hemsley was charged with third degree criminal possession of marijuana, a class E felony, and unlawful growing of cannabis, a misdemeanor. At that time, sheriff’s detectives discovered approximately 500 marijuana plants, ranging from three to six feet in height, following a tip regarding the plants’ location.
• Kenneth G. McKersie, 29, Norwich, was indicted on charges of second degree burglary, a class C felony; two counts of first degree reckless endangerment, a class D felony; petit larceny, a class A misdemeanor; and third degree unlawful fleeing a police officer in a motor vehicle, a class A misdemeanor.
According to his indictment, McKersie , on or about Sept. 12 in the City of Norwich, did knowingly enter and unlawfully remain at a Beebe Avenue residence, committing the crime of larceny when he stole a Panasonic phone from within. It’s then alleged that McKersie, “under circumstances evincing a depraved indifference to human life,” recklessly engaged in conduct which created a grave risk of death to another person, driving a 2001 Chevrolet Silverado at a speed of approximately 80 miles per hour and passing through the red light at the intersection of North Broad and Mitchell streets, subsequently passing through the intersection of Mitchell and Silver streets without stopping.
• Ivon G. Miller, 35, homeless, was indicted on charges of second degree burglary, a class C felony; third degree burglary, a class D felony; and two counts of petit larceny, a class A misdemeanor.
According to his indictment, Miller, in August or September of 2012 in the Town of Pharsalia, did knowingly enter and unlawfully remain in a Balsam-Tyler Road residence, committing the crime of larceny when he stole eight gold rings, a gold chain, a weed eater, a comforter and a garden gnome. It’s also alleged that Miller, on or about Oct. 10 in the Town of Norwich and in concert with another, unlawfully entered a Valley View Park residence, committing the crime of larceny when he stole a Playstation 3 console and an undisclosed amount of U.S. currency.
• Michael A. Fletcher, 30, Bainbridge, was indicted on two counts of fourth degree grand larceny, a class E felony, and one count of fourth degree criminal mischief, a class A misdemeanor.
It’s alleged that Fletcher, on or about Oct. 12 in the Village of Bainbridge and in concert with another, did steal property consisting of a credit/debit card after breaking the passenger side window of a vehicle, causing an estimated $270 in damage and stealing a purse which contained five credit cards belonging to another individual. It’s also alleged that Fletcher, again in concert with another, stole a second purse from a vehicle parked in a private driveway, which contained twelve credit cards belonging to another individual.
• Mark J. Williams, 48, Endicott, was indicted on two counts each of second degree burglary, a class C felony, and petit larceny, a class A misdemeanor.
It’s alleged that Williams, on or about Sept. 12 in the Town of Afton, did knowingly enter and unlawfully remain in a pair of private residences located on State Highway 7 and Main Street, committing the crime of larceny when he stole a wallet and iPod.
• Caitlyn M. Richmond, 19, Guilford, was indicted on charges of fourth degree grand larceny, a class E felony, and petit larceny, a class A misdemeanor.
According to her indictment, Richmond, on or about Oct. 27 in the Town of Bainbridge, did steal property consisting of a credit/debit card belonging to another individual without that individual’s consent.
• Daniel J. Brazee, 19, Norwich, was indicted on charges of second degree burglary, a class C felony, and petit larceny, a class A misdemeanor.
It’s alleged that Brazee, on or about Nov. 27 in the City of Norwich, did knowingly enter and unlawfully remain in a West Main Street residence, committing the crime of larceny when he stole an XBox console from within.
• Valden W. Pittsley, 48, Pitcher, was indicted on charges of first degree sex abuse, a class D felony, and endangering the welfare of a child, a class A misdemeanor.
According to his indictment, Pittsley, in March of 2003 in the Town of Pitcher, subjected another person – under the age of 11 – to unwanted sexual contact.
• Herbert L. Hovencamp Jr., 59, Smyrna, was indicted on charges of third degree criminal possession of a controlled substance, a class B felony; fourth degree criminal possession of a controlled substance, a class C felony; and fifth degree criminal possession of a controlled substance, a class D felony.
It’s alleged that Hovencamp, on or about July 11 in the Village of Sherburne, did knowingly and unlawfully possess, with the intent to sell, 97 oblong white tablets, each marked Watson/349, allegedly identified as the narcotic drug Dihydrocodeinone, with Acetaminophen. The narcotics had an aggregate weight of 69.15 grams, which is more than two ounces.
• Tryquan A. Robinson, 20, Utica, was indicted on two counts of third degree criminal possession of a controlled substance, a class B felony; and two counts of fifth degree criminal possession of a controlled substance, a class D felony.
It’s alleged that Robinson, on or about Aug. 1 in the City of Norwich, did knowingly and unlawfully possess, with the intent to sell, 83 glassine envelopes of the narcotic heroin, as well a “chunky, white substance,” later identified as the narcotic cocaine.
• Richard J. Apicerni, 50, Mt. Upton, was indicted on one count of offering a false instrument for filing, a class E felony.
According to his indictment, Apicerni did knowingly complete and sign a United States Department of Justice ATF Form 4473 Firearms Transaction Record, certifying that the information he provided was true, accurate and correct while knowing said information was false. It’s alleged that Apicerni failed to disclose pending felony charges against him, and was subject to a felony indictment in Ulster County. It’s also alleged there is an open arrest warrant for Apicerni’s arrest in Florida.
