Seven appear in county court

NORWICH – Seven individuals charged with a variety of felony and misdemeanor charges appeared in county court Friday and Monday, two admitting to violations of probation, while the other five pleaded guilty and were subsequently sentenced, one to three years in state prison.
• Nathaniel R. Cosby, 38, Syracuse, was sentenced to three years in state prison with two years post release supervision, a sentence that will run concurrent with a separate, Cayuga County sentence he is currently serving.
Cosby was indicted by a Chenango County grand jury in March, charged with two counts of third degree criminal possession of a controlled substance, a class B felony, criminal tampering with evidence, an E felony, and seventh degree criminal possession of a controlled substance, an A misdemeanor. It was alleged that Cosby – in concert with another individual – knowingly and unlawfully possessed four individually wrapped baggies of cocaine with an aggregate weight of 17.55 grams, as well as 224 glassine envelopes of the narcotic heroin, with the intent to sell. The charges stem from a Dec. 20, 2011 incident that occurred at a Norwich hotel when Cosby, in an attempt to destroy the drugs, tried to flush them down the toilet.
• Christopher J. West, 30, Bainbridge, was sentenced to five years probation and must successfully complete the county’s Treatment Court program after pleading guilty to one count of driving while ability impaired by drugs, a class D felony.
It’s alleged that West, in February of 2012, operated a motor vehicle on county Road 39 in the Town of Bainbridge, failing a field sobriety test and admitting he had taken prescription drugs. According to his grand jury indictment, West’s 9-year-old son was in the vehicle at the time of his arrest. He has two prior driving while intoxicated convictions, dating from Feb. 24, 2004 and June 22, 2007 in Broome County Court.
• Christine A. Furgison, 35, North Norwich, admitted to violating the terms and/or conditions of her probation and was sentenced to six months at the Chenango County Correctional Facility.
Furgison was placed on probation in February of 2012 after pleading guilty to one count of third degree grand larceny, a class D felony, subsequently violating her probation when charged with endangering the welfare of a child in the Town of New Berlin. In addition, Furgison admitted testing positive for Morphine, Percocet and marijuana on several occasions.
• Chad R. Rogers, 40, Smyrna, admitted to violating the terms and/or conditions of his probation and was sentenced to one year at the Chenango County Correctional Facility with credit for time served.
Rogers was placed on probation in March of 2009, subsequently violating his probation when charged with driving while intoxicated in the Town of Pharsalia in January of 2011. Rogers also admitted to consuming or possessing alcohol on two occasions, also a violation of his probation.
• Nancy Losee, 41, Sherburne, pleaded guilty to one count of fifth degree criminal sale of a controlled substance, a class D felony, and was sentenced to five years probation.
It was alleged that Losee, on or about Aug. 6, 2011 in the Village of Sherburne, sold the narcotic drug Oxycodone at a village business. According to Chenango County District Attorney Joseph McBride, Losee would have faced jail time if not for a serious medical condition. He added that the sale of prescription narcotics are “not only killing people,” but “damaging the quality of life for all in Chenango County.”
• John M. Janus Jr., 21, Bainbridge, pleaded guilty to one count of first degree aggravated unlicensed operation of a motor vehicle, a felony, and driving while intoxicated, a class A misdemeanor. He was sentenced to one year interim probation under the condition he successfully complete the county’s Treatment Court program, and could face up to four years in state prison if he were to violate the terms and/or conditions of his interim probation.
Said McBride, “If you drink and drive, I’m going to do everything within my power to see you go to state prison.”
• Michelle F. Stolarcyk, 41, Whitney Point, pleaded guilty to one count of driving while intoxicated, a class A misdemeanor, and was sentenced to three years probation.
It was alleged that Stolarcyk, on or about Aug. 11, 2011 in the Town of Greene, operated a motor vehicle while in an intoxicated condition. If she were to violate the terms and/or conditions of her probation, she could face up to one year at the Chenango County Correctional Facility.
