Oxford planning board pores over zoning ordinance
OXFORD – Saturday morning, during a Village of Oxford Special Planning Board meeting, members listened to a detailed explanation from pro-bono consulting attorney David Slottje of a drafted amendment to the village’s 1970 zoning ordinance. About 17 people attended the meeting held in the village hall. The drafted amendment is intended to clarify and confirm what is already in the existing zoning ordinances, explained Slottje. The amendment passed in the hands of the planning board after the village trustees voted to turn it over for their consideration last Wednesday.
“The amendment is not meant to be a change, it is just meant to confirm the Landowners Coalition’s analysis of what is already in the zoning ordinance,” said Slottje. On Dec. 11, the village board tabled a nine-month moratorium on shale-gas drilling, after representatives of the Central New York Landowners Coalition threatened legal action should they enact it. The CNYLC claimed a moratorium would be illegal as there was no public purpose for it.
Members of the CNYLC have asserted the existing zoning ordinance does not permit gas drilling within the village limits because it does not mention it.
“Some of these changes may seem petty ... a lot of it is just cleaning it up and updating it to the present,” said Slottje, referring to seemingly benign changes and substitutions in the drafted amendment. Explaining why he felt the zoning ordinance needs a clarification, Slottje pointed to an instance in Pennsylvania where a gas company was able to drill without the municipality’s permission. According to one section of the Pennsylvania municipality’s zoning ordinance, the gas company would need to apply for a permit to drill, but another clause said the planing board “shall” issue a permit. Using a literal interpretation of the zoning ordinance, the gas company’s lawyers were able to argue there was no need to apply for a permit because the zoning ordinance said they “shall” be issued one anyway, Slottje said.
The Oxford planning board decided to read and review the ammendment further. Another special planning board meeting has been scheduled for Wednesday at 5 p.m., allowing the planning board members to have their decision ready for the village board of trustees meeting taking place later that night at 7:30.
