Five plead guilty in county court
NORWICH – Five individuals recently appeared in Chenango County Court, all of whom pleaded guilty to the charges brought against them.
• Tanya M. Osman, 25, Greene, was sentenced to five years probation after pleading guilty to aggravated driving while intoxicated on April 8.
Osman was ordered to pay $1,375 in fees to over the course of the next twelve months, and must also pay $560.50, plus a 5 percent surcharge, in restitution to an alleged victim whom Osman is accused of having struck with her motor vehicle. The alleged victim, who was jogging at the time of the incident, was a high school athlete, and underwent shoulder surgery as a result of the accident.
• Edwin E. Jenson, 23, Afton, pleaded guilty to driving while ability impaired by drugs, a class E felony, on Monday.
Jenson attested that he did knowingly and unlawfully operate a motor vehicle while his ability was impaired by drugs on November 12, 2012 on State Highway 7 in Afton. He is set to be sentenced to five years probation and must successfully complete the county’s Treatment Court program. If Jenson does not meet the eligibility requirements for Treatment Court, he will serve a split sentence of six months incarceration at the Chenango County Correctional Facility and five years probation.
Chenango County Judge Frank B. Revoir offered a warning to Jenson stating if he violates any law or uses any alcohol or drugs before he is sentenced, he could face the maximum penalty of 1 1/3 to 4 years in state prison.
Sentencing was adjourned until August 23, 2013.
• Martin P. Kincaid, 29, Utica, pleaded guilty to third degree criminal possession of a controlled substance, a class B felony.
Kincaid was indicted by a Chenango County grand jury in March and was accused of knowingly and unlawfully possessing 16 individually knotted packages of the narcotic cocaine, with the intent to sell, on or about Jan. 25, 2013 in the Town of Norwich.
Kincaid was sentenced Friday to five years in state prison and three years post-release supervision.
• Julian C. Kappel, 24, Binghamton, pleaded guilty to fourth degree criminal possession of stolen property, a class E felony. He was sentenced to interim probation.
• Christopher E. Joy, 45, Norwich, pleaded guilty Friday to third degree criminal sale of a controlled substance, a class B felony.
Joy was indicted by a Chenango County grand jury in March. It was alleged that Joy, on or about Jan. 25, 2013 in the Town of Norwich, did knowingly and unlawfully sell the narcotic drug cocaine to an undercover police officer.
Joy is set to be sentenced at a later date.
