Five appear in County Court
NORWICH – A man accused of practicing dentistry without a license was sentenced in county court - while others appeared for the purpose of arraignment and sex offender designation.
• Victor Nino, 59, Nassau County, was sentenced to four months incarceration in the Chenango County Correctional Facility to be followed by five years of probation, and the payment of $26,279.29 in restitution for his convection on one count of third degree grand larceny, a class D felony. Nino was also sentenced to a three-year conditional discharge for unauthorized practice, a class E felony.
It was alleged that Nino and an accomplice were running an unlicensed dentist’s office on county Route. 39 in the Town of Afton. They were subsequently arrested by the New York State Police working in tandem with the New York State Office of the Attorney General’s Medicaid Fraud Control Unit in early May of 2011.
Nino’s plea agreement stipulated that he pay $76,279.29 in restitution by last December in order to avoid a stint in the Chenango County Correctional Facility. Since then, sentencing has been adjourned a number of times. On Monday, attorney for the prosecution Ralph Tortora of the NYS Attorney General’s Office, informed the court that Nino had only produced $50,000 of the agreed upon sum, following which Chenango County Judge Frank B. Revoir Jr. sentenced Nino to four months incarceration and ordered that he pay the remander of the restitution within a maximum period of 24 months after his release.
