One denies allegations, another confesses; two others plead guilty in county court


NORWICH – Two individuals accused of having violated the terms of their probation appeared in Chenango County Court Monday, one vehemently denied the allegations brought against him, the second confessing to at least one of charges he is facing. Two other individuals subsequently pleaded guilty to felony charges.
• Kevin Urgo, 35, Oxford, denied allegations that he had violated the terms and conditions of his probation by allegedly operating a motor vehicle which was registered out of state and did not have an ignition interlock device.
“The defendant was convicted of a D felony with the only condition being to not drive a vehicle without an interlock, he did just that and got another DWI,” said Chenango County District Attorney Joseph McBride.
Urgo was remanded without bail to the Chenango County Correctional Facility. He will re-appear again at a later date on the matter of the alleged probation violation ,and authorities anticipate that separate charges will be brought against him for the alleged DWI.
• Jeremy Q. Decker, 26, Bainbridge, was sentenced to a determinate sentence of three years in state prison to be followed by ten years post release supervision for violating the terms of his probation.
In May of 2011, Decker pleaded guilty to the crime of first degree sexual abuse; a class D violent felony, for allegedly molesting a three-year old female.
Although it was alleged that Decker had violated the terms of his probation in more then one way, he only admitted to the most serious of the allegations brought against him, that he had engaged in sexual relations with a male under the age of 18.
“When I get out of prison I need to stop breaking the law,” said Decker prior to sentencing.
Although Decker is currently registered as a level 2 sex offender, Chenango County Judge Frank B. Revoir Jr. speculated that that would most likely be reviewed prior to Decker’s release from state prison.
• Richard A. Hadley Jr., 41, Binghamton, changed his plea of not guilty to guilty for the crime of first degree criminal contempt – a class E felony – and will be sentenced to an indeterminate sentence of one to three years in state prison to run concurrent with a sentencing issued out of Broome County Court on charges of second degree assault and third degree arson, as stipulated in an agreed upon plea agreement. A final order of protection was also issued for the victim.
It was alleged that Hadley, on or about Nov. 5, 2012, did repeatedly make phone calls to his soon-to-be ex-wife, in knowing and willful violation of an existing order of protection. While Hadley admitted that the district attorney’s office did indeed have sufficient evidence to prove he not only made the phones calls but also of the threatening nature of the calls, he staunchly stated that he has no recollection of making the aforementioned threatening comments. Instead, he claimed that his memory of the matter was foggy due to the influence of alcohol and prescription medications, which were at the time afflicting his judgement.
• Timothy P. McCarthy, 34, New Berlin, pleaded guilty to one count of second degree forgery and one count of fourth degree larceny, both class D felonies. He is currently auditioning for Treatment Court and sentencing will take place in August.
It was alleged that McCarthy forged a check at a New Berlin business and accepted donations to help enter his daughters into beauty pageants while not in fact doing so, instead keeping the donated monies for his personal use.
