Seven appear in county court; three sentenced

NORWICH – Seven individuals charged with various felony and misdemeanor crimes appeared in Chenango County Court Friday and Monday, including three who were sentenced at the conclusion of their court appearance.
• Darin M. Moody, 43, Binghamton, was sentenced to four months of weekends in jail and five years probation after pleading guilty to one count of third degree burglary, a class D felony.
“Mr. Moody for some reason seems to have a normal life, but another side of it is taking things that are not his,” said Chenango County District Attorney Joseph McBride. “This is too irresponsible, when you are coaching football the kids can’t show up to practice and be asking ‘where’s the coach.’”
Said Moody prior to sentencing, “I am just trying to move forward, I got a lot of people behind me.”
Before Chenango County Judge Frank B. Revoir pronounced sentence, he cautioned Moody that should he violate the terms and conditions of his probation he could end up facing the maximum sentence for third degree burglary. It was also made clear Moody is not to enter any Wal-Mart without the corporation’s written permission.
• Heather A. Wrench, 25, Bainbridge, admitted to having willfully violated the terms and conditions of a probation sentence stemming from a 2010 third degree burglary conviction. Specifically, Wrench admitted to having failed to maintain employment. She now faces re-sentencing for her initial conviction, which could land her anywhere from one year local time in the Chenango County Correctional Facility to upwards of seven years in state prison.
• Leonard D. Vandermark, 66, Greene, convicted of first degree sexual abuse, a class D felony, appeared for the purpose of a sex offender risk level determination. Vandermark was assessed as a Level One sex offender, or low risk of repeat offense. Neither the district attorney nor counsel objected to the assignment of the level one status while Judge Revoir reserved judgement.
• James J. Keeney, 42, New Berlin, was sentenced three to six years in state prison with shock treatment, previously pleading guilty to third degree burglary, a class D felony. He was also ordered to pay $2,950 in restitution.
Although the victims were present they chose to forgo their right to speak prior to sentencing.
“A long history of crimes has brought him [Keeney] before this court as it has before others,” said McBride before sentencing. “It has had a devastating effect on the victims and they drove up here from Connecticut for this preceeding. He violated their trust and broke into their summer home.”
“... just like to say I am sorry to them,” said Keeney. “I have taken all sorts of steps to get away from drugs, I realize I do have a very serious drug problem.”
• Joshua W. Quinn, 21, Sherburne, admitted violating the first count of a four count violation of probation petition and was subsequently re-sentenced to one year in the Chenango County Correctional Facility. Quinn admitted his failure to attend and complete Drug Treatment Court, a stipulation of his probation from a 2012 conviction of fifth degree criminal possession of a controlled substance, a class D felony.
“You’re a smart kid, you have the ability to stay away from this and any other court,” said McBride.
Chenango County Public Defender and the defendant’s legal counsel, James D. Cameron, also spoke before sentencing.
“There are a lot of positives about him. He has made some poor decisions, but he knows he is capable of making good choices.”
“It is sad to see Treatment Court not work,” said County Judge Revoir. “I do think you are smart, smarter than the average person who comes through treatment court ... I see you continuing your education and making something of your life.”
• Matthew Bullock, 41, Greene, indicted on two counts of second degree criminal sexual act, a class D felony; and one count of endangering the welfare of a child, waived his right to a jury trial by his peers in favor of a bench trial which will take place at a later date.
• John P. Winn, 27, Bainbridge, denied a two count violation of probation petition and was remanded back to Chenango County Correctional Facility. Winn was initially convicted of felony driving while ability impaired by a drug in 2011 and third degree criminal possession of a controlled substance in 2012 for which he was sentenced to two five-year terms of probation to run congruently.
