Grand jury indictments handed down

NORWICH – A total of 13 indictments were handed down by the Chenango County Grand Jury on Dec. 11 in the Chenango County Court. According to District Attorney Joseph McBride, 2013 was a record year for the most indictments handed down in Chenango County with a total 153, including the last indictments for the year this December.
• Martin A. Provo, 51, Guilford, was indicted two counts of the class B felony of criminal possession of a controlled substance in the third degree, the class C felony of criminal possession of marijuana in the first degree and the class D felony of reckless endangerment in the fourth degree.
The indictment alleges that on or about Sept. 21, 2013, at a residence in the Town of Oxford at approximately 9 a.m., Provo knowingly and unlawfully possessed one Zip-lock bag with 21 pre-packaged baggies containing the narcotic drug heroin with intent to sell it. It also alleges that he possessed one-half ounce or more of heroin, possessing 20.85 grams, which is more than one-half ounce.
The indictment alleges Provo also possessed marijuana with the aggregate weight of 10 or more pounds, possessing 5,391 grams, which is more than 10 pounds.
Additionally it is alleged that at approximately 11:45 a.m., Provo did recklessly engage in conduct which created a risk of death to another person, firing a loaded gun in the direction of a male victim’s pick-up truck.
• Julian Boyd-Campbell, 24, Binghamton, was indicted for the class B felony of assault in the first degree and the class D felony of assault in the second degree.
The indictment alleges that on or about Nov. 10, 2013, on Birdsall Street in City of Norwich at 5:44 p.m., Boyd-Campbell intended to cause serious physical injury to another person by cutting a male victim with a dangerous instrument, inflicting a deep laceration to the lower left leg of the victim.
• William A. Knapp, 37, Bainbridge, was indicted for the class D felony of assault in the second degree and the class A misdemeanor of assault in the third degree.
The indictment alleges that on or about Sept. 1, 2013, on West Main Street in the Village of Bainbridge, Knapp, with the intention to cause serious physical injury to another person, grabbed a male victim by his shirt and threw him off a staircase, causing him to land face first on the concrete sidewalk.
According to the indictment, he victim sustained serious physical injuries including several broken ribs, a broken nose a broken orbital socket and lacerations that required 10 stitches.
• Adam L. Robinson, 20, Norwich, was indicted for the class D felony of burglary in the third degree and the class A misdemeanor of petit larceny.
The indictment alleges that on or about Oct. 12, near Balsam Tyler Road in the Town of Pharsalia, Robinson did enter or remain unlawfully in a seasonal hunting camp and – while acting in concert with others – did commit the crime of larceny by stealing property consisting of two four-wheeler ATVs, a television and hunting clothes.
• Dwayne O. Weir, 38, Norwich, was indicted for the class D felony of burglary in the third degree and the class A misdemeanor of petit larceny.

The indictment alleges that on or about Oct. 11, on Rexford Falls Road in the Village of Sherburne at approximately 2:20 p.m., Chlad knowingly and unlawfully – while acting in concert with others – possessed 60 glassine envelopes containing the narcotic drug heroin with intent to sell it. It is also alleged Chlad, believing that certain physical evidence would be produced and intending to prevent such production, intentionally moved a quantity of heroin from her residence and concealed in at a separate location.
• Steven A. Manwarren, 46, Sherburne, was charged with the class B felony of criminal possession of a controlled substance in the third degree, the class E felony of tampering with physical evidence and the class A misdemeanor of criminal possession of controlled substance in the seventh degree.
The indictment alleges on or about Oct. 11, 2013, on Rexford Falls Road in the Village of Sherburne at approximately 2:20 p.m., Manwarren knowingly and unlawfully – while acting in concert with others – possessed 60 glassine envelopes containing the narcotic drug heroin with intent to sell it.
• Hennessy C. Hawkins, 27, Rome, was indicted for two counts of the class B felony of criminal possession of a controlled substance in the third degree, the class D felony of criminal possession of a controlled substance in the fifth degree and two counts of the class A misdemeanor of criminal possession of a controlled substance.
The indictment alleges, on or about Oct. 30, on County Road 32 in the Town of Norwich, Hawkins knowingly and unlawfully possessed two different types of narcotic drugs with intent to sell them. Hawkins allegedly possessed four knotted wraps containing a chunky substance, cocaine and 10 glassine envelopes containing heroin with the intent to sell both narcotic drugs. The indictment also alleges Hawkins knowingly and unlawfully possessed cocaine with an aggregate weight of 500 milligrams or more, possessing 1,109 milligrams of cocaine.
• Kajaun A. Bunn, 30, Brooklyn, was indicted for the class B felony of criminal possession of a controlled substance in the third degree and the class a misdemeanor of criminal possession of a controlled substance in the seventh degree.
The indictment alleges, on or about Oct. 15, on Plymouth Street in the City of Norwich at approximately 4:59 p.m., Bunn knowingly and unlawfully possessed a narcotic drug, possessing 10 glassine envelopes containing the narcotic drug heroin, with intent to sell it.
• Randy R. Buck, Jr., 27, Sherburne, was indicted for the class B felony of criminal possession of a controlled substance in the third degree, the class E felony of tampering with physical evidence, and the class A misdemeanor of criminal possession of a controlled substance in the seventh degree.
The indictment alleges Buck, on or about Oct. 11 in the Town of Columbus, knowingly and unlawfully possessed the narcotic drug with the intent to sell it. It alleges Buck possessed six glassine envelopes containing heroin. The indictment also alleges Buck intentionally prevented the production of evidence by tossing two bags of heroin out of a car window.
• Douglas P. Slate, 50, Plymouth, was indicted for the class D felony of driving while intoxicated.
The indictment alleges on or about Nov. 16 on North Broad Street in the City of Norwich at 12:58 a.m., Slate operated a 2003 Ford Ranger while in an intoxicated condition, allegedly observed to have slurred speech, bloodshot and watery eyes and his breath smelled strongly of an alcoholic beverage.
Slate was previously convicted of a felony DWI on May 9, 2009 and the misdemeanor of operating a motor vehicle while having a blood alcohol content of .08 or more on Aug. 16, 2007. He was sentenced to five years probation and required to pay $2,295 in fines and surcharges by one year after his sentencing date. Probation was later terminated and Slate was resentenced to one year incarceration at the Chenango County Correctional Facility with credit for time served. His remaining fines were to be paid to the Chenango County Clerk within one year of his release date.
• Audra H. Brendel, 42, Bainbridge, was indicted for the class E felony of aggravated driving while under the influence and the class E felony of driving while under the influence.
The indictment alleges, on or about Oct. 3, on County Road 39 in the Village of Bainbridge at approximately 10:20 p.m., Brendel operated a vehicle while intoxicated and having a blood alcohol content of .18 of one percent or more. It is alleged Brendel was operating a Subaru Legacy under the influence of alcohol with a BAC of .20 of one percent, which is more than .18 of one percent. It is also alleged that Brendel was observed to sway as she walked, have slurred speech, bloodshot and watery eyes and her breath smelled strongly of alcohol.
Brendel has a previous misdemeanor conviction of operating a motor vehicle with a BAC of .08 of one percent or more on Aug., 12, 2004 out of the Town of Colesville Court in Broome County.
The indicted individuals will appear in court at a later date.
