Two appear in County Court
NORWICH — Two individuals appeared in Chenango County Court Wednesday for their arraignments with regard to violation of probation petitions. Both men were remanded to the Chenango County Correctional Facility on bail set by Acting County Court Judge James E. Downey.
• Luman C. Craver, a man currently on probation appeared before the judge with his defense counsel Scott Clippinger.
According to Chenango County District Attorney Joseph McBride, probation officers documented that Craver used illegal substances — opiate pills — while serving probation. McBride said approximately a month after Craver’s probation sentence he was “busted for taking percocets.”
The reading of the violations was waived by the defense. The violation of probation petition alleges the defendant violated on three counts. A denial was entered by Clippinger on his client’s behalf.
McBride said he was prepared to proceed with the hearing Monday, yet Clippinger asked the court for additional time to prepare.
The hearing was adjourned by Judge Downey until Friday, Oct. 17.
Downey set bail at $5,000 cash or $15,000 bond.
Clippinger — after discussing with his client — asked the court to grant Craver a furlough. According to Clippinger, his client was supposed to help his mother with the foundation of her home.
“He has always shown up, your Honor,” said Clippinger regarding his client. “He has never not shown up. We’re asking for a furlough until Monday.”
Said McBride, “I respectfully object to that, judge.”
“It is alleged you were using substances when you weren’t supposed to be,” said Downey. The furlough was denied and Craver was sent to the Chenango Correctional Facility.
He is to reappear Oct. 17.
• Terry L. Crandall, Norwich, appeared before the court for allegedly violating the terms and conditions of his probation. He was represented by his attorney John Cameron. Crandall was sentenced to probation for the charge of criminal sexual act in the third degree on July 16, 2012.
The reading of the allegations of the violation was waived by the defense, and Cameron entered denials on all counts.
With regard to bail, Cameron told the court his client is employed Monday through Friday and has lived in the Town of Norwich for an extended period.
“My client is finishing a weekend sentence and has two more weekends left,” said Cameron to Downey. Cameron asked that Crandall be released on his own recognizance. The weekends Crandall has been serving at the CCCF were for a prior DWI conviction in May of 2014.
McBride requested Crandall be remanded to jail without any bail.
“He has been drinking post his DWI conviction,” said McBride. “He blew a .078 at probation.”
Said McBride, “He is a registered sex offender, Judge.”
McBride introduced a pending endangering the welfare of a child charge that Crandall is facing in the Town of Norwich Court. According to both the DA and the Judge, pending matters can be used in bail consideration.
McBride told the court that it is alleged Crandall got into the bed of a young female (a minor) and whispered sexually explicit content into her ear. McBride also said there is a written statement where it says Crandall told said female that he wanted to do harmful and violent actions to her private parts.
“He is a flight risk and a danger to the community,” said McBride.
Judge Downey asked the probation officer present if there would be an amended violation to the terms and conditions of Crandall’s probation, that added the allegations McBride laid out with regard to the female. The probation officer answered in the affirmative.
“These are mere allegations,” said Cameron. “The prior DWI conviction is a fact.”
Crandall is to appear on charges of endangering the welfare of a child, a class A misdemeanor, on Thursday night at the Town of Norwich Court.
“Maybe some conversations are in order to do this in one fell swoop,” said Downey.
Crandall’s violation of probation hearing has been adjourned until Oct. 17 in Chenango County Court. By that time, Crandall will have appeared in the Town of Norwich Court. The amended violation of probation documents may be prepared by the Oct. 17 date, and the probation officer in charge of that is expected to be present as he was not present Wednesday.
Bail for Crandall was set at $2,500 cash, $5,000 bond, or $10,000 property.
