Predicate felon given chance to get sober

NORWICH— Convicted grand larceny defendant was sentenced in Chenango County Court by Judge Frank B. Revoir, Jr. on Nov. 14.
Katherine M. Daniels, 38, Utica, was charged this past January with two counts of grand larceny in the third degree, a class D felony; one count of grand larceny in the fourth degree, a class E felony; two counts of conspiracy in the fifth degree, a class A misdemeanor; and one count of conspiracy in the sixth degree, a class B misdemeanor.
Daniels pleaded guilty to one count of grand larceny in the third degree on Aug. 11.
It is alleged Daniels and two others stole from a Town of Norwich business. The thefts are alleged to have occurred on three separate occasions: Jan. 8, 19 and 21. Daniels and two others allegedly stole several Blue Ray DVDs and other expensive items from the store.
Daniels and two other individuals were arrested following an investigation of more than $19,000 worth of stolen merchandise by the local business's loss prevention team and the Chenango County Sheriff's Office with help from the Utica Police Deparment and the Oneida County Sheriff’s Office.
Daniels lawyer, Kayphet Mavady and District Attorney Joseph A. McBride told Revoir that Daniels has had a “substantial history of drug addiction since her youth” and began stealing to support her habit. They also said since being released from jail – where she was remanded for her current charges – she has been receiving treatment for her addiction.
“Get some counseling and stay off the drugs, because you cannot steal no matter what you think,” said McBride. “If you steal again, I will put you away for 70 years, because at some point society has to be protected. You are off the dope now, there is no excuse.”
McBride also said this is Daniels fourth felony conviction and because of Daniels family support and her attempt at sobriety, she was given a favorable disposition.
“First and foremost, I am sorry. My drug addiction has brought me to places I never thought I would go. I know I am a predicate felon, but I am so much more than that. I am thankful I have a second chance at redemption,” said Daniels, crying, to Revoir.
Revoir said to Daniels that “a lot of people went to bat for her,” including her “supportive husband,” because Daniels was looking at life sentences. He added, “I believe you are sincere.”
Daniels was sentenced to two to four years in the New York State Department of Corrections and to complete the treatment program at Willard Treatment Facility as part of her incarceration. She must complete the treatment program, or she could serve the maximum four years.
“Thank you,” said Daniels, crying, as she was placed in handcuffs. She said good-bye to her husband and was escorted out of the courtroom.
Daniels will be required to pay a $5,000 restitution following her release from prison.
