Former Corrections Officer, alleged road rage murderer arraigned on 17 counts
NORWICH – The alleged Bainbridge road rage shooter and murderer was arraigned on 17 counts Friday, Dec. 5 in Chenango County Court.
John M. Guzy, 56 of Bainbridge was arraigned on charges related to the shooting of Derek S. Prindle, 26 of Afton and his father, Derek D. Prindle 60 of Afton. Guzy – a former corrections officer and retired police officer – allegedly told authorities he was in a fight with the victims due to road rage.
The 26-year-old died of his injuries. The deceased young man's father recovered after receiving surgery for his gunshot injuries.
Derek D. Prindle attended Guzy's arraignment with his friends and family on Friday.
The 17 charges Guzy was arraigned on included murder in the second degree, a class A-1 felony; attempted murder in the second degree, a class B felony; two counts of assault in the first degree, a class B felony; two counts of criminal use of a firearm in the first degree, a class B felony; criminal possession of a weapon in the second degree, a class C felony; criminal possession of a weapon in the third degree, a class D felony; tampering with physical evidence, a class E felony; driving while intoxicated, a class A misdemeanor; and six counts of criminal possession of a weapon in the fourth degree, a class A misdemeanor.
Guzy attended court with his newly-hired private attorney, Benjamin Bergman of Binghamton.
The accused murderer pleaded not guilty on all counts.
It is alleged on Oct. 27 at approximately 1:25 p.m. in the parking lot of Peak Fitness located at 2907 State Highway 7 in Bainbridge, Guzy did intentionally cause the death of Derek S. Prindle by shooting him in the chest with a .25 caliber Beretta Jetfire semi-automatic handgun.
Derek S. Prindle died of a lacerated aorta after being shot in the chest.
It is also alleged at the same time and place, Guzy did cause serious physical injury to Derek D. Prindle by shooting him in his abdomen with the same gun.
Derek D. Prindle had spleen, colon and renal injuries, which required him to undergo surgery.
After the alleged murder and attempted murder, Guzy allegedly prevented the production of evidence by attempting to conceal or destroy the handgun used in the crimes. It is alleged Guzy threw the handgun out of his truck window and it struck a tree.
Guzy also allegedly was driving while intoxicated before and after the incident at Peak Fitness. It is alleged Guzy operated his 2007 Chevrolet Trail Blazer LS motor vehicle with a blood alcohol concentration of .11 of one percent of alcohol.
During the investigation of the Peak Fitness incident, authorities searched Guzy's residence located at 211 Elm St. in Bainbridge. They found six firearms including a Smith and Wesson 44 mag revolver, Ruger speed 6, .38 special revolver; Colt semi-automatic MKIV, .45 caliber handgun; Glock 9 mm semi-automatic handgun; Jennings Model 22 pistol and a Ruger police service 6, .38 caliber handgun.
Authorities found several other weapons at Guzy's residence including a cane sword, billy, blackjack, bludgeon, plastic knuckles, electronic dart gun, electronic stun gun, gravity knife, switchblade knife, ballistic knife, metal knuckles, chukka stick, sand bag, sand club, wrist-brace type slingshot or slung-shot and a shirken or “Kung Fu star.”
Judge Frank B. Revoir, Jr. remanded Guzy back to the county jail without bail, where he has been incarcerated since his arrest on Oct. 27.
Revoir also ordered a full order of protection for the surviving victim, Derek D. Prindle.
Guzy is to appear in court at a later date.
