Young convicted thief receives 179 days; repeat drunk driver gets weekends

NORWICH – A young man convicted of stealing off road motorcycles and a repeat drunk driver were sentenced on Dec. 15 in Chenango County Court.
• Rebel L. Whitman, 20, Norwich, was indicted for criminal possession of stolen property in the fourth degree, a class E felony, on Sept. 17 of this year.
Whitman was arraigned for the charge on Sept. 29. He pleaded guilty to criminal possession of stolen property in the fourth degree on the same day.
Judge Frank B. Revoir, Jr. remanded Whitman back to the Chenango County Correctional Facility in lieu of $5,000 cash or $10,000 property bond, which were the same amounts originally set by the local court.
Sentencing was adjourned for the purpose of investigating whether or not Whitman was eligible for the Shock Incarceration Program.
Whitman has three previous misdemeanor convictions related to theft. He has also previously received outpatient drug and alcohol treatment in Chenango County.
In the fall of 2013 Whitman was arrested for possessing stolen property. It was alleged he had stolen a sound mixing board from a residence in Greene.
Whitman appeared before Revoir to be sentenced for criminal possession of stolen property in the fourth degree on Dec. 15. He was still incarcerated in the county jail at the time of his sentencing.
It is alleged on July 28, at approximately 9 p.m., at 396 Cumming Rd. in the Town of Greene, Whitman was in possession of two off road motorcycles with the approximate value of $3,000.
Whitman's lawyer, Alyssa Congdon, said she spoke with her client about all of his options and believed he was receiving a “fair disposition.”
“I do believe he will succeed in treatment court and be in a better position than he is in now,” said Congdon.
Revoir said to Whitman, “You are really starting to build up a rap sheet at a really young age. You have now been convicted of a felony.”
Revoir said if Whitman is convicted of another felony in the future, he will be sent to prison. Since Revoir is the judge for drug treatment court, he also said, “We are going to become friends over the next year.”
Whitman was sentenced to 179 days in the county jail, less time served, and five years probation with the completion of one year of drug treatment court.
The total restitution owed is $3,609.70. Whitman is required to pay one third of the total amount, which is $1,203.25. His two co-defendants will be required to pay the rest of the restitution.
• Gary N. Hackett, Jr., 42, Guilford, pleaded guilty to aggravated unlicensed operation of a motor vehicle in the first degree, a class E felony, and driving while intoxicated, a class A misdemeanor, on Dec. 15.
It is alleged on June 15, at approximately 1:28 p.m., in the Town of Guilford, Hacket was operating a motor vehicle on public highway with a blood alcohol concentration of one percent, while knowing his license was suspended.
Before sentencing, Hackett said, “I am just thankful to the courts.” He turned to the Second Assistant District Attorney Thomas Bowen and said, “And thank you, sir.”
“I am going to spare you the long speech, you have probably heard it before anyway,” said Revoir. “I don't have to tell you what happens if it happens again.”
Revoir said the only reason he agreed to allowing Hackett to do weekends is because Hackett is employed and is the “breadwinner” for his household.
Hackett was sentenced to four months of weekends at the county jail, which will begin on Jan. 2, and five years probation. He also received one year conditional discharge for the DWI charge, which will require him to enroll in the Ignition Interlock Device Program.
