Man arraigned for allegedly assaulting NPD officer

NORWICH— Man accused of assaulting a Norwich City Police officer was arraigned on Jan. 5 in Chenango County Court by Judge Frank B. Revoir, Jr.
David Quintana, 33, Oxford, was indicted on Dec. 17, 2014 for assault in the second degree, a class D felony; criminal contempt in the second degree, a class A misdemeanor; and assault in the third degree, a class A misdemeanor.
It is alleged on Nov. 22, 2014 at Denny's Restaurant and Bar, located at 75 N. Broad St. in the City of Norwich, Quintana did intentionally cause physical injury to Norwich City Police Officer Adam Francis while he was performing a lawful duty.
While being placed in a patrol vehicle by Officer Francis, Quintana allegedly kicked the door of the patrol vehicle shut while the officer's hand was between the door and the door frame. The officer's hand was crushed, which caused him pain, swelling and bruising.
It is also alleged that Quintana violated a court mandate signed on Dec. 10, 2013 by Judge James E. Downey, preventing him from patronizing establishments that sell alcoholic beverages for on-premise consumption until Dec. 9, 2014.
Quintana was arraigned on Jan. 5 for the class D felony of assault in the second degree, the class A misdemeanor of criminal contempt and the class A misdemeanor of assault in the third degree.
He pleaded not guilty on all counts
According to Ferrarese, Quintana posted a $2,500 bond set by Norwich City Court and was released. Norwich City Court had originally set a $2,500 cash bail or $2,500 bond for Quintana.
“I would request bail be raised to at least $5,000 cash. The defendant was indicted for allegedly assaulting a police officer and faces a substantial state prison sentence,” said Ferrarese.
Ferrarese also said a majority of Quintana's wrap sheet was based out of Orange County, NY. “Obviously he has contacts outside of the area, and I think he poses a flight risk,” said Ferrarese.
Cameron objected to Ferrarese's request to raise bail. “He has been out of jail three weeks. If he posed a flight risk, he wouldn't be here today, Judge,” said Cameron.
Cameron also said Judge Downey of Norwich City Court used to be a District Attorney and after assessing Quintana's case, Downey determined the appropriate amount for bail.
“The fact that Downey was previously a District Attorney or reviewed the case is irrelevant. He has now been indicted and is no longer just someone sitting in City Court,” said Ferrarese.
Ferrarese also said Quintana was indicted for criminal contempt, because he directly violated a court order. Ferrarese said he violated the court order on more than one occasion.
“He failed and couldn't follow orders. He clearly poses a danger to our community,” added Ferrarese.
Cameron agreed that the point he made about Downey was irrelevant, but he said Downey did recognize there was speculation about whether or not Quintana was actually in the bar at the time of his arrest.
Revoir continued bail at $2,500 cash or $2,500 bond.
Since Quintana already posted the $2,500 bond, he was not remanded.
Revoir ordered Quintana be monitored by the Chenango County Drug Court Coordinator, James Everard.
“You obviously understand the importance of showing up. If you fail to show up, your bail status could be revoked, and you could be remanded back to jail,” said Revoir.
“You don't have to worry. I will be here, sir,” said Quintana.
Quintana is to appear in court at a later date.
