Alleged sex offender arraigned on 11 counts; “drug dealer” fails to appear

NORWICH – An alleged sex offender and another man, a “known drug dealer” were arraigned on Jan. 7 in Chenango County Court by Judge James E. Downey.
• William J. Quigley, 53, Sidney, was indicted on Dec. 17, 2014 for course of sexual conduct against a child in the first degree, a class B felony; four counts of criminal sexual act in the first degree, a class B felony; four counts of criminal sexual act in the second degree, a class D felony; and two counts of endangering the welfare of a child, a class A misdemeanor.
It is alleged that between September 2006 and January 2008 at two locations in the Town of Oxford, Quigley did perform oral sex on a male child under 13 years of age on more than one occasion. The child was nine years of age when the alleged sex crimes first took place in Sept. of 2006.
It is also alleged during the months of Sept. and Oct. of 2006, at a private residence in the Town of Oxford, Quigley did perform oral sex on another male child less than 15 years of age on more than one occasion. The child was 13 years of age when the alleged sex crimes took place.
Before Quigley was indicted in Dec. of 2014, he was indicted months before on similar charges for the same case, but his lawyer had some of the charges dismissed due to insufficient evidence.
District Attorney Joseph A. McBride re-presented the evidence before a grand jury in Dec. of 2014. The grand jury found the evidence sufficient. Quigley was then indicted for all counts related to the case, including some additional counts.
Quigley previously requested CPS records regarding an investigation the agency conducted in 2011, involving him and the victims of the alleged sex crimes. The defense said if sexual abuse had occurred, then the male victims would likely have mentioned it during the 2011 investigation.
If they did not mention it during the investigation, Quigley believes he and his lawyer can make a case against the victims' credibility.
Downey granted Quigley's request for the records and said he would review the records to see if they could be used in Quigley's defense.
Quigley was arraigned on Jan. 7 for course of sexual conduct against a child in the first degree, a class B felony; four counts of criminal sexual act in the first degree, a class B felony; four counts of criminal sexual act in the second degree, a class D felony; and two counts of endangering the welfare of a child, a class A misdemeanor.
According to McBride, the Town of Oxford court had originally set bail at 50,000 cash or 100,000 bond. Quigley had paid $10,000 cash to post the $100,000 bond.
McBride did not request bail be raised, but he did request orders of protection for the alleged victims.
Downey issued a full order of protection for both the victims.
Downey also said he had received the CPS records and had not yet had a chance to review them. He will review them at a later date to see if Quigley can use them for his defense.
Although McBride was opposed to Quigley receiving the CPS records, he did not object to Quigley receiving the records because Downey had already granted Quigley's request.
Quigley will go on trial for the alleged sex crimes this year, and he is to appear in court at a later date.
• Jose I. Gonzalez, 47, Norwich, was indicted on two counts of criminal possession of a controlled substance in the third degree, a class B felony and two counts of criminal possession of a controlled substance in the seventh degree, a class A misdemeanor.
It is alleged on or about Oct. 1 at approximately 1:34 a.m. at the parking lot of a City of Norwich business, Gonzalez did knowingly and unlawfully possess 45 envelopes containing the narcotic drug heroin and 10 oblong white tablets marked “176” containing the narcotic drug Dihydrocodeinone with Acetaminophen with the intent to sell.
Gonzalez did not show up to his arraignment on Jan. 7 for the charges he was indicted on last December.
John D. Cameron said he did not know where his client was and that he had not heard from him.
McBride requested $50,000 cash bail for Gonzalez, since he is a “known drug dealer” and has a “rap sheet out of Queens, NY.”
"He has a history of failing to appear,” said McBride.
Downey issued a warrant for Gonzalez's arrest and set bail for $50,000 cash or 100,000 bond.
Gonzalez is to appear in court at a later date.
