Sex offender released without bail against DA’s recommendation
NORWICH – A 25-year-old homeless sex offender was arrested Monday and was released on his own recognizance against the Chenango County District Attorney’s recommendation.
Anthony John Biviano was arrested at 11 a.m. Tuesday by an employee of the Norwich Police Department.
Biviano was charged with failing to register his change of address as a sex offender, a class E felony offense.
Biviano – who on the New York State Sex Offender Registry also uses the aliases of ‘A.J.’ or ‘Biv’ – was convicted in April, 2009, of attempted rape in the second degree. According to the registry, the description of the offense included sexual intercourse and sexual contact with a 13-year-old female victim who was a non-stranger.
Biviano was sentenced to 10 years of probation for the offense.
Initially when Norwich Police arrested Biviano on Monday, he was held pending an arraignment with a judge, which took place that day.
“We did ask based on the fact Mr. Biviano is a frequent visitor to the criminal justice system that he be remanded on $20,000 bail,” said Chenango County District Attorney Joseph McBride.
McBride added that Biviano is homeless and has no ties to the community. He explained the bail would secure his reappearance in court.
Biviano was released on his own recognizance.
“I’m frustrated he was released without bail,” said McBride.
Biviano is to appear in Norwich City Court to answer to his charge for failing to register/change of address at a later date.
