Three arraigned in county court
NORWICH – An Oxford man accused of sexually abusing a 12-year-old female victim and two convicted offenders charged with failure to register or verify were arraigned recently in Chenango County Court by Judge Frank B. Revoir, Jr.
• Scott M. Brazee, 39, Oxford, was arraigned on the charges of three counts of sexual abuse in the first degree, a class D felony, and endangering the welfare of a child, a class A misdemeanor.
It is alleged, per the indictment, that on or about more than one day in December of 2014, at a Canal Street residence in the Village of Oxford, Brazee did subject a 12-year-old female victim to sexual contact on more than one occasion.
Brazee entered a plea of not guilty on all counts.
District Attorney Joseph A. McBride said Brazee is charged with multiple counts of violent felonies and is facing up to 21 years in state prison for the alleged sex crimes.
“He has a long criminal history since 1992,” said McBride.
McBride requested a $45,000 cash bail, which was an increase from the $20,000 cash bail that was set by the local court.
Brazee's public defender, John Cameron, requested bail be continued in the amount set by the local.
According to Brazee, he will be staying with his father in Plymouth if he is released from jail.
Revoir remanded Brazee back to the county jail on $20,000 cash bail or a $200,000 bond.
Revoir also issued full orders of protection in favor of the victim.
One of Brazee's family members or friends that attended court for his arraignment said, “We love you,” as he was escorted out of the courtroom.
Brazee is currently incarcerated at the Chenango County Correctional Facility, and he is to reappear in court at a later date.
• Anthony J. Biviano, 26, Norwich, was arraigned on the charge of failure to register or verify as a sex offender.
It is alleged, per the indictment, that on or about Jan. 10 in the City of Norwich, Biviano – as legally required – did fail to register with the New York State Division of Criminal Justice Services Sex Offender Registry within 10 days of his move on Dec. 30, 2014 from 35 Silver Street in Norwich to an unknown address.
Biviano was convicted of the violent felony of attempted rape in the second degree in April of 2009.
According the New York State Sex Offender Registry. He had sexual intercourse and sexual contact with a 13-year-old female, non-stranger victim.
Biviano pleaded not guilty.
“This defendant has a long history of criminal behavior and has every reason to flea the jurisdiction,” said McBride.
McBride said he had another felony for filing a false instrument to the police by writing down an invalid address, after his initial arrest for failure to register.
Cameron said the charge was reduced to a misdemeanor and it will be handled in Norwich City Court. He also said there was bail set by City Court for that charge.
According to Biviano, he will be living with father and registering there if he is released from jail.
McBride requested Revoir at least continue bail at the amount of $5,000 that was set by the local court.
Revoir asked if drugs or alcohol was an issue, and McBride said Biviano has a long history of drug and alcohol abuse but that it “does not apply to this matter.”

• Todd E. Dewey, 38, Afton, was arraigned on the charge of failure to register or verify as a sex offender, a class E felony.
Currently, there is no information available regarding Dewey's underlying sexual offense.
It is alleged, per the indictment, that on or about Jan. 1 at 105 Kelsey Brook Park in the Town of Afton, Dewey did knowingly create an email account and internet identifier on Facebook, and as of Jan. 26, he – as legally required – failed to register the email or internet identifier with the New York State Division of Criminal Justice Services Sex Offender Registry within 10 calendar days.
Dewey pleaded not guilty.
Cameron said Dewey was released on his own recognizance by the local court.
McBride said he was not asking for any additional bail.
Revoir continued Dewey's ROR status.
According to Dewey, he lives with his wife in Afton. Revoir said he must only reside at the Afton residence with his wife and have no violations of the law.
“Stay off of Facebook,” said McBride. “No social media at all, not just Facebook.”
“I will,” said Dewey. “Yeah, I have no internet or nothing.”
Dewey is to reappear in court at a later date.
