Grand jury indicts seven

CHENANGO COUNTY — A Chenango County grand jury chose to indict seven residents this month for crimes including – but not limited to – driving while intoxicated and manufacturing meth.
In a grand jury proceeding, the prosecutor explains the law to the members of the grand jury, and presents the evidence against a defendant. The members on the grand jury then decide based on what was presented, whether or not there is reasonable evidence to show that a felony was committed and if there is enough reason to believe the defendant in question committed said felony offense.
• Dawn M. Schneider, 42, South Otselic, was indicted on one count of promoting prison contraband in the first degree, a class D felony.
It is alleged that Schneider, on or about Jan. 16, 2015 in the Town of Norwich, did knowingly and unlawfully bring dangerous contraband into the Chenango County Correctional Facility. Per the indictment, Schneider is accused of possessing a glassine envelope containing heroin in her wallet, which was located upon being booked into the CCCF.
• Thomas Toomer II, 34, Oxford, was indicted on the charges of operating a motor vehicle while he had .08 of one percentum or more by weight of alcohol in his blood, a class E felony; and driving while intoxicated, a class E felony.
Toomer is accused of driving a motor vehicle on a public highway at 3:58 p.m. on April 3, 2015 in the Town of McDonough. It’s alleged he had .09 of one percentum of alcohol in his blood as shown by chemical analysis of his breath. Further, it is alleged Toomer swayed as he walked, had bloodshot, watery eyes, and his breath smelled of alcoholic beverage.
• Russell W. Rowe, 39, Afton, was indicted on two charges: aggravated unlicensed operation of a motor vehicle in the first degree, a class E felony; and driving while intoxicated, a class E felony.
Rowe allegedly drove a motor vehicle on a public highway in the Town of Afton on or about 10:25 p.m. on April 16, 2015 while in an intoxicated condition. It’s further alleged that Rowe knew, or had reason to know that his New York State Drivers License had been revoked or suspended.
• Larry J. Meeker Jr., 33, Bainbridge was indicted on the charges of operating a motor vehicle while he had .08 of one percentum or more by weight of alcohol in his blood, a class D felony; and driving while intoxicated.
It’s alleged that on or about March 14, 2015 in the Town of Coventry, Meeker did operate an ATV on a public highway while he had .11 of one percentum of alcohol in his blood as shown by chemical analysis of his breath.
The class D felony of driving while intoxicated accuses Meeker of operating said vehicle while in an intoxicated condition. Per the indictment, Meeker’s speech was slurred, he swayed as he walked, had bloodshot eyes, and his breath smelled of alcoholic beverage.
• Three individuals were indicted and charged with identical crimes: Luis A. Calixto, 33, Norwich; Dorothy M. Owens, 32, Norwich; and Hollianne M. Fitch, 29, Norwich were indicted on various felony offenses.
Each were charged with three counts of criminal possession of a controlled substance in the third degree, a class B felony.
The first count alleges that the three, on or about April 29, 2015 in the City of Norwich, did knowingly and unlawfully possess a medicine container containing 12 grams of methamphetamine with the intent to sell it.
The second count alleges that six glassine envelopes were unlawfully possessed.
The third criminal possession count accuses Calixto, Owens and Fitch of possessing one or more preparations, compounds, mixtures or substances containing meth, its salts, isomers, or salts of isomers with the intent to sell it, and said preparations were an aggregate weight of one eighth of an ounce or more. It’s alleged that the preparation containing meth had an approximate weight of 12 grams.
Calixto, Owens, and Fitch were additionally indicted on the class D felony of unlawful manufacture of methamphetamine. While in concert with one another, it’s alleged they knowingly and with the intent to use, possessed ammonium nitrate, white gas, lithium metal, and a two liter bottle to manufacture meth.
The three additionally face the class E felony charge of criminal nuisance in the first degree. Per the indictment, the three are accused of allowing individuals to gather at their Mitchell St. residence in the City of Norwich to engage in unlawful sales of controlled substances. It’s further alleged the three benefitted monetarily from the controlled substances transactions that took place at the residence.
All of the seven indicted by the grand jury this month will appear in Chenango County Court at a later date or their felony arraignments.
