One sentenced in County Court in relation to 2011 heroin bust

NORWICH – Chenango County Court this past Monday, Feb. 29, heard a case related to the narcotic drug heroin, stemming from an arrest made in 2011.
Judge Frank B. Revoir Jr. presided over court while First Assistant District Attorney Michael D. Ferrarese was representing the people.
Shinyrra K. Legrand-Thomas, 22, and then only 18, of Syracuse was originally arrested on Dec. 20, of 2011 with the co-defendant Nathaniel Raheem Cosby then 37, also of Syracuse.
Both were taken into custody following a drug bust incident which took place at the Howard Johnson Hotel.
Cosby was originally charged with two counts of criminal possession of a controlled substance in the third degree, a class B felony; unlawful possession of marijuana, a violation; and criminal nuisance in the second degree; as well as false personification, both misdemeanors.
During the booking process, it was alleged that Cosby had earlier identified himself to officers as another individual.
Legrand-Thomas faced similar charges, including two counts of criminal possession of a controlled substance in the third degree, unlawful possession of marijuana; and criminal nuisance in the second degree.
Allegedly the Norwich City Police responded to a complaint of an odor of marijuana at the Howard Johnson hotel, meeting Legrand-Thomas in the hallway outside of her first-floor room.
Allegedly according to law enforcement at the scene, Legrand-Thomas stated she was staying at the downtown hotel with her boyfriend, whom she originally identified using a false name. Police then escorted Legrand-Thomas to the couple’s room, where police say she unsuccessfully attempted to open the door using her card key, prompting Cosby, inside the room, to ask if she was alone.
After it was made known that Legrand-Thomas was in the company of law enforcement, allegedly from inside the room the officers heard “smashing, the sound of the toilet being repeatedly flushed and yells of “the door’s jammed, the door’s jammed,” read a previous article written by The Evening Sun on this matter.
Once inside the smell of marijuana was allegedly present, a number of plastic sandwich bags was seen scattered throughout the room, the toilet was overflowing, causing the floor to be soaked in water, and a bathroom ceiling tile was out of place.
The Chenango County Sheriff’s Office’s K-9 unit, did assist in the search of the room eventually allegedly finding 222 individually packaged baggies of heroin, three ounces of cocaine and an undisclosed amount of marijuana.
Cosby, who already allegedly had a wrap sheet out of Syracuse containing 29 arrests, six convictions on five felonies and one misdemeanor with multiple charges associated with controlled substances, has since been sentenced for his crimes, and is currently incarcerated in the Willard Correctional Facility
Legrand-Thomas was finally back in Chenango County Court this past Monday for a plea and sentencing with her attorney John Cameron. The hold up in the court proceedings was alleged to be a result of Legrand-Thomas serving other convictions, for other drug related crimes, in other counties.
Legrand-Thomas was to enter a plea of guilty to the second count of her charges, criminal possession in the third degree a class B felony, and this would be in full satisfaction of all other charges stemming from this matter.
Revoir did read the second count of the indictment saying, “on Dec. 20, 2011 at approximately 9:34 p.m. at Howard Johnson's Hotel and with another you did possess 222 glassine envelopes of the narcotic drug heroin and did have intent to sell.”
To which Legrand-Thomas did enter a guilty plea to at this time.
“Ms. Legrand-Thomas at the time was only 18-years old and has been incarcerated in other counties. The one year determinate sentence she will receive is a just sentence,” said Ferrarese. “The defendant was offered an opportunity at rehab and she has turned it down. She is involved in the drug trade and is possibly doing drugs. You’re an extremely young woman, be there for your child.”
At this time Cameron did attest that due to her age they were hoping to have this sentenced as Youthful Offender due to her age at the time of the arrest, saying, “she has a child in Syracuse she wants to get back to.”
Revoir did not grant the Youthful Offender Status.
Legrand-Thomas was given a chance to speak, “I just want to apologize to you and the courts for this taking so long to get this situation done and over with.”
Revoir concluded by offering up some explanation and advice, “It took several warrants to you here in court. I deny your request for a YO, it has taken almost four years to get you here and to this point in court. I hope you turn your life around and take care of your child. I hope you don’t get mixed up with people like Mr. Cosby anymore, who is now in State Prison.”
Legrand-Thomas was sentenced to a one year determinate sentence to be served at The Chenango County Correctional Facility, with any possible credit served.
A written waiver of appeal was signed at this time.
