Woman sentenced to six months for criminal possession

NORWICH – The case of Jodi E. Babcock was heard when the Chenango County Court convened in the morning hours of May 23.
Babcock appeared with her assigned public defender, Aaron Dean. First Assistant District Attorney Michael D. Ferrarese was present in court to represent the people of Chenango County, while The Honorable Judge Frank B. Revoir Jr. presided over the case.
Babcock was previously arrested back on October 22, 2015, on a charge of criminal possession of a controlled substance in the seventh degree, a misdemeanor. This arrest came after a 911 call was placed alleging that a stabbing had occurred on Turner Street in the Town of Preston. When New York State Troopers arrived on the scene, they found that Babcock and the other two occupants of the car were all separated and no one was injured. During the investigation, the suspects were allegedly found to be in possession of about three grams of heroin.
After this initial arrest, Babcock was pulled over in the town of Bainbridge by Chenango Sheriff’s Deputy Lawrence for traffic violations in the early morning hours of January 29, 2016. During the course of the traffic stop, Deputy Lawrence allegedly located several hypodermic needles, as well as the narcotic drug heroin, it was determined that she possessed the heroin with intent to sell. Babcock currently had an outstanding bench warrant for her arrest, issued by the City of Norwich Court.
Babcock was charged with criminal possession of a controlled substance in the third degree, a class B felony; criminal possession of a controlled substance in the seventh degree, a class A misdemeanor; as well as several vehicle and traffic violations.
After her initial appearance in court, Babcock agreed to enter a plea of guilty to the higher charge of criminal possession of a controlled substance in the third degree, a class B felony. During her sentencing, Babcock admitted that she had intended to sell the 10 glassine envelopes of heroin which she was caught with during the traffic stop, in order to fuel her addiction and purchase more drugs for herself.
Ferrarese commended Babcock's response in jail since her arrest, “From the first time I met Jodi, in the Preston town courthouse, she looks like a different person. It is obvious to me that since she was put in the Chenango County jail, she has not used (heroin) and looks much better.”
Babcock's defense attorney, Aaron Dean said, “Ms. Babcock looks at this arrest as a blessing in disguise. She had feared that she was heading for an overdose had she not been arrested. She has taken responsibility for her actions, and has shown remorse. She hopes drug treatment programs will help her to live a life free of drugs.”
Judge Revoir shared the same sentiments, saying, “I agree with Mr. Ferrarese, you look like a completely different person. This is an attempt to turn things around for you. I hope with the help of your family, you are successful with treatment. Good luck both here and in Delaware County.”
Babcock was sentenced to six months incarceration in the county jail, along with five years probation following her release. After the conclusion of proceedings, she was transferred to the Delaware County jail, as she is a resident of Sidney.
A written waiver of appeal was signed at the conclusion of this matter.
