Meth, heroin and cocaine discussed in court cases, two remanded to CCCF

NORWICH – Two men were sent back to the Chenango County Correctional Facility following their arraignments in Chenango County Court Monday, May 23.
Karlton A. Tompkins, 38, of Mount Upton, appeared on charges of violation of probation. Due to his lengthy criminal history, which spans back many years, First Assistant District Attorney Michael Ferrarese, who represented the people of Chenango County, described Tompkins as a “flight risk”.
Tompkins was arrested on Dec. 10, 2015, after New York State Troopers responded to a call concerning a man sleeping at the wheel of a vehicle, with the engine still running, in a parking lot of a business on State Route 8 in the Town of Guilford. An investigation ensued, and it was determined that Tompkins was under the influence of drugs. When officers attempted to arrest Tompkins, he allegedly physically resisted and fought them, until he was subsequently handcuffed and subdued. He was charged with the misdemeanors of operating a motor vehicle while impaired by drugs; criminal possession of a controlled substance in the seventh degree; and obstruction of governmental administration in the second degree.
During his arraignment, attorney for the defendant, Aaron Dean, argued that Tompkins should be released on his own recognizance. However, Ferrarese and The Honorable Judge Frank B. Revoir Jr., who presided over proceedings, did not agree.
“This defendant is facing two to seven years in state prison,” said Ferrarese. “He was not performing well in drug treatment, and there has been allegations of alleged meth use.” He proposed a cash bail of $50,000 to the Court. Judge Revoir agreed with Ferrarese, saying that he had given Tompkins numerous chances at drug treatment, and he had failed each time and constantly lied about his consistent drug use.
Tompkins entered a plea of not guilty for each charge. Revoir remanded him back to the CCCF without bail.
In the second arraignment of the day, Samuel Rivera, 45, of no fixed address, appeared in front of Judge Revoir on four felony counts, as well as two misdemeanor counts. He was charged with three felony counts of criminal possession of a controlled substance in the third degree, one count of nuisance in the first degree and two class A misdemeanor counts of criminal possession of a controlled substance in the seventh degree.
Rivera was taken into custody after Chenango County Sheriff’s deputies and members of the Sidney Police Department executed a “no knock” search warrant at a residence on Spreutels Lane in the town of Guilford. During their investigation, police seized 280 packages of heroin, just over an ounce of cocaine, digital scales, packaging material and cash.
During his arraignment, First ADA Michael Ferrarese, who represented the people of Chenango County, said, “This defendant has a lengthy history of criminal activity, both in and out of state. He has been arrested and charged with similar charges to the ones that he is currently facing in New York City and Massachusetts.” He proposed a bail amount of $20,000 cash or $100,000 bond.
Attorney for the defense, Aaron Dean, attempted to show Rivera's ties to the community, saying that he has lived in the locality for over a year, and is currently employed with a property management company, so if he were to be released, he would not be a flight risk.
After Rivera entered a plea of not guilty to each count, Revoir remanded him back to the CCCF in lieu of $15,000 cash bail or $30,000 bond.
