Man sentenced to five years in state prison for attempted burglary
NORWICH – The Chenango County Court convened for a morning session on Friday, June 10, where they heard the case of Michael J. Mathis. Assistant District Attorney Laura Parker represented the people of Chenango County, while The Honorable Judge Frank B. Revoir Jr. presided over matter.
It is alleged that on Dec. 1, 2015, Mathis, 30, of Sherburne, knowingly entered a residence on Classic St. in the village of Sherburne without permission. He then proceeded to steal an Xbox console, controllers and several games. Mathis entered a guilty plea to the charge of attempted burglary in the second degree, a class D felony.
After being sworn in, Judge Revoir asked Mathis if he was indeed the one who committed this burglary, to which Mathis replied yes. After Revoir was satisfied with the defendant’s admission of guilt, he asked Mathis if he was previously sentenced in the Chenango County Court on previous burglary and grand larceny charges back in Nov. 2011, to which Mathis said yes.
As Mathis is a predicate felon, Judge Revoir sentenced him to five years in the New York State Department of Corrections, followed by five years post release probation. Along with this, Mathis was also ordered to pay restitution in the amount of twenty dollars.
During sentencing, Parker was given a chance to speak on the behalf of the people. She said, “Although there was no violence involved in this case, it is still a felony. As you (Revoir) stated, the defendant has two previous felony convictions. A sentence of five years incarceration followed by five years probation is appropriate.”
When Mathis was provided with an opportunity to speak, he said, “I would like to apologize for my actions before and now. I hope (that) when I exit the department of corrections, I will be a changed man.”
A written waiver of appeal was signed at the conclusion of proceedings.
