Manufacture of meth, grand larceny charges among June indictments

NORWICH - A Chenango County grand jury met earlier last week to determine indictments for the month of June, 2016 and subsequently decided that there was enough evidence against five individuals to charge them with at least one felony level crime.
• Richard L. Brewer Sr., 52, of Smyrna, was indicted on two felony counts. Brewer was charged with one count of unlawful manufacture of methamphetamine in the third degree, a class D felony; and one count of unlawful disposal of meth lab material, a class E felony.
It is alleged that Brewer, on June 3, 2016, at a residence on County Road 18, in the Town of Pharsalia, while acting in concert with another, did knowingly and with intent to use, possessed pseudoephedrine, sulfuric acid, lithium metal, white gas, ether, plastic bottles, coffee grinders and coffee filters to unlawfully manufacture methamphetamine.
The second felony charge alleges that Brewer, at the aforesaid time and place, and while acting in concert with another, did knowingly dispose of meth lab material by placing plastic bottles, lithium batteries, starting fluid cans, coleman fuel cans, coffee filters, pseudoephedrine blister packs and other meth by-products in multiple burn piles, located behind his residence. This act created a substantial risk to human safety and a danger to the environment.
• Gwenda J. Knapp, 47, of Smyrna, was indicted on two felony counts. Knapp was charged with one count of unlawful manufacture of methamphetamine in the third degree, a class D felony; and one count of unlawful disposal of meth lab material, a class E felony.
It is alleged that Knapp, on June 3, 2016, at a residence on County Road 18, in the Town of Pharsalia, while acting in concert with another, did knowingly and with intent to use, possessed pseudoephedrine, sulfuric acid, lithium metal, white gas, ether, plastic bottles, coffee grinders and coffee filters to unlawfully manufacture methamphetamine.

• Jenifer A. Newton, 32, of Norwich, was indicted on one felony charge, as well as one misdemeanor charge. Newton was charged with one count of promoting prison contraband in the first degree, a class D felony; and one count of criminal possession of a controlled substance in the seventh degree, a class A misdemeanor.
It is alleged that Newton, on Jan. 24, 2016, in the Town of Norwich, while being confined in the Chenango County Correctional Facility, did knowingly possess prison contraband. At approximately 1:45 p.m., the defendant, while being incarcerated at the CCCF, did knowingly and unlawfully possess in her person, three orange tablets wrapped in plastic wrap. These tablets each contained the narcotic substance Buprenophine, which is a dangerous contraband.
The misdemeanor charge alleges that Newton did knowingly and unlawfully possess the controlled substance Buprenophine.
• Edward R. Fagan, 40, of Norwich, was indicted on one felony charge and one misdemeanor charge. Fagan was charged with one count of criminal contempt in the first degree, a class E felony; and one count of criminal obstruction of breathing or blood circulation, a class A misdemeanor.
It is alleged that Fagan, on May 30, 2016, in the City of Norwich, at 10:15 p.m., was willfully in violation of a duly served order of protection, of which the defendant had knowledge. Fagan intentionally violated the order of protection, issued by the Norwich City Court on Nov. 17, 2015, which didn't expire until Nov. 17, 2016, by intentionally choking an individual at a residence on Mitchell Street, in the City of Norwich.
The misdemeanor charge alleges that Fagan did place his hands around the individuals neck while he choked her, which prevented her from breathing. This act was allegedly done with intent to impede the individuals normal breathing or circulation of blood.
• Sheldon H. Rose, 43, of Norwich, was indicted on one felony charge and one misdemeanor charge. Rose was charged with one count grand larceny in the fourth degree, a class E felony; and one count of petit larceny, a class A misdemeanor.
It is alleged that Rose, on March 8, 2016, in the Town of Norwich, did steal property exceeding one thousand dollars. Rose was hired by an individual to put a new roof on their house, located on Bourbon Street, in the Town of Norwich. The defendant obtained $1,100 from the individual as payment. As pursuant to article 3-A of the Lien law of the State of New York, the defendant was required to hold said $1,100 as trustee in trust for the benefit of the individual and expend the funds only for the purpose of performing roof work at the individuals home. Rose did knowingly, intentionally and unlawfully misappropriate approximately $1,100 of said trust funds for his own use and benefit.
The petit larceny complaint alleges that the defendant did steal $700 which was given to him to perform work on the individuals house, which he failed to do.
