Man sentenced to state prison after third DWI in five years

NORWICH – The Chenango County Court convened for a morning session on Monday, June 27, where the case of Larry J. Meeker Jr. was heard. Assistant District Attorney Laura Parker represented the people of Chenango County, while Meeker was represented by Diane DiStefano, who appeared in place of the absent F. Paul Battisti. The Honorable Judge Frank B. Revoir Jr. presided over matters.
It was alleged that Meeker, 33, of Bainbridge, operated an ATV on a public highway on March 14, 2015, in the Town of Coventry, while he had 0.11 of one percent of alcohol in his blood as shown by chemical analysis of his breath.
The class D felony of driving while intoxicated accuses Meeker of operating said vehicle while in an intoxicated condition. Per his indictment in May of 2015, Meeker’s speech was slurred, he swayed as he walked, had bloodshot eyes, and his breath smelled of alcoholic beverage.
In a plea agreement with the District Attorney's Office, Meeker agreed to enter a plea of guilty to the charge of operating a motor vehicle while he had .08 of one percent or more by weight of alcohol in his blood, a class D felony.
After being sworn in, the defendant was asked by Judge Revoir if he was indeed guilty of the alleged incident that occurred in the Town Of Coventry on March 14, 2015, to which Meeker pleaded guilty.
This is Meeker's third felony DWI conviction in the last five years. He previously was found guilty of two separate felony DWIs in June and July of 2012.
Before sentencing, Parker was given an opportunity to speak on behalf of the people. She said, “Mr. Meeker is a 34 year-old man. This is his sixth conviction. Incarceration seems to be the only time that he is not drinking and driving.”
Judge Revoir agreed with the Assistant DA's comments.
“At your age, you have this record. At some point, you have to get over it,” he said. “God forbid you injure or kill someone, then you're looking at sentences with life on the end.”
Revoir sentenced Meeker to an indeterminate sentence of one and a third to four years incarceration in the New York State Department of Corrections, with a one year license revocation. Meeker will also be subject to the ignition interlock system, for which he will be assessed 50 percent of the costs and will have to pay back a total of $1,520 in restitution within 18 months of his release.
A written waiver of appeal was signed at the conclusion of proceedings.
