Unadilla woman caught using stolen debit card

NORWICH – The Chenango County Court convened for a morning session on Monday, July 18, where the case of Kristina N. Hyer was heard.
Hyer, 30, of Unadilla, appeared in court with appointed attorney Aaron Dean. District Attorney Joseph McBride represented the people of Chenango County, while the Honorable Judge Frank B. Revoir Jr. presided over matters.
It was alleged that sometime during May, 2015, Hyer possessed a stolen debit card, which she used to rent a room at the Susquehanna Motel in Bainbridge, costing $165. Hyer also faces separate charges of fourth and fifth degree criminal possession of stolen property, petit larceny, criminal possession of a forged instrument and forgery in Delaware County.
In an agreed upon disposition with the DA's Office, Hyer agreed to enter a plea of guilty to the class E felony of criminal possession in the fourth degree.
After Hyer's plea of guilty was accepted by the court, McBride was given an opportunity to speak on behalf of the people.
“She's 30 years old. She has a lot of life ahead of her. She's been involved in petty crime for at least the last 10 years, it appears,” he said. “She needs to make a decision: if she is going to be a productive member of society, or continue down the path she has.”
Hyer was also provided with a chance to speak on her own behalf.
“I do have a long history of drug abuse. I have four kids. I just want to be able to get out and be with them. I need to do this for my kids, and I want to,” she said.
Before sentencing, Judge Revoir conveyed his thoughts on the case, saying, “It is clear that drugs and alcohol appear to be co-mingled with your criminal activity.”
Revoir also made a note on the record that he recommended the defendant be considered for drug treatment programs in prison.
Revoir sentenced Hyer to an indeterminate sentence of one to three years in the New York State Department of Corrections. She will also be required to pay back restitution, with a minimum payment of $75 each month, beginning the third month after her release.
A written waiver of appeal was signed at the conclusion of proceedings.
