Bail remains at $25,000 for woman charged with selling narcotics

NORWICH – Kimberly Harrington, one of the two women arrested after a search warrant executed at a residence on Cortland St., in the City of Norwich earlier in the week reappeared in Norwich City Court on Thursday, Aug. 18.
Harrington, 27, who listed her address as homeless, stood charged with one count of criminal possession of a controlled substance in the third degree, a class B felony; and one count of criminal nuisance in the first degree, a class E felony.
The criminal possession of a controlled substance in the third degree alleges that Harrington knowingly and unlawfully possessed a narcotic drug with intent to sell it. In this instance, the alleged narcotic drug was crack cocaine. The criminal nuisance in the first degree charge alleges that Harrington knowingly conducted or maintained a premise or place where persons came or gathered for purposes of engaging in the unlawful sale of controlled substances.
At the beginning of proceedings on Thursday, Harrington was assigned attorney Scott Clippinger to represent her.
Clippinger argued that Harrington should be released on her own recognizance, saying, “Ms. Harrington has lived in this community for 15 years. I don't believe that she is a flight risk. (She's) not trying to avoid this, (she's) trying to deal with it. I ask that she be released on her own recognizance.”
Assistant District Attorney Laura Parker, who represented the people of Chenango County in the matter, said, “The people believe that bail should remain the same. When she was arrested, (Harrington) indicated that she was homeless. She is facing a class B felony. $25,000 cash bail is appropriate in this case.”
The Honorable Judge James E. Downey, who presided over matters, was the last to speak on the issue of bail. “I don't think it's any secret that Ms. Haarrington has a drug addiction problem,” he said. “That's why they call it an addiction, people who can't get off drugs for their children, that's when you know it's horrible. I know no greater love than that of a mother's love for her child, and drugs overcame that.”
Harrington waived felony hearings on both charges, and Judge Downey transferred jurisdiction of the case to Chenango County Court.
At the conclusion of proceedings, Judge Downey kept Harrington's bail amount at $25,000 cash, before remanding her back to the custody of the Chenango County Correctional Facility.
