Sex abuse, burglary and DWI among August indictments

NORWICH - A Chenango County grand jury met earlier last week to determine indictments for the month of August, 2016 and subsequently decided that there was enough evidence against four individuals to charge them with at least one felony level crime.
• Charles E. Miller, 37, of Afton, was indicted on nine felony counts. Miller was charged with nine separate counts of possessing a sexual performance by a child, a class E felony.
The first count of the indictment alleges that Miller, on or about June 13, 2016, at a residence on Jennings Lane, in the Town of Afton, did allegedly possess a video of a sexual performance by a child.
Counts two through nine of the indictment allege that Miller allegedly possessed images of sexual performances by children.
• Koty C. Head, 27, of Norwich, was indicted on one felony charge, as well as one misdemeanor charge. Head was charged with one count of burglary in the third degree, a class D felony; and one count of petit larceny, a class A misdemeanor.
The felony count of the indictment alleges that Head, on or about July 29, 2016, at a residence on Delaware Square, in the City of Norwich, while acting in concert with others, did knowingly enter and remain unlawfully in a building with intent to commit a crime. Thereafter, the defendant, while acting in concert with others, did commit the crime of larceny therein by allegedly stealing numerous construction tools from within, including, but not limited to a DeWalt drill, drill driver, two 20-volt batteries, jig saw, battery chargers, drywall gun, electric DeWalt sawzaw and two Irwin clamps.
The misdemeanor count of petit larceny alleges that Head, at the aforementioned time and place, while acting in concert with others, did allegedly steal numerous construction tools from a victim.
• David Quintana, 34, of Oxford, was indicted on two separate felony charges. Quintana was charged with one count of aggravated unlicensed operation of a motor vehicle in the first degree, a class E felony; and one count of driving while intoxicated, a class E felony.
It is alleged that Quintana, on or about July 23, 2016, on Silver Street, a public highway in the City of Norwich, at approximately 3:48 in the forenoon, did operate a 1993 BMW 3231, a motor vehicle, while his ability to operate said vehicle was impaired by alcohol or while an intoxicated condition and/or while having more than .08 of one percentum by weight of alcohol in his blood, in violation 1142 of the Vehicle and Traffic Law, and while knowing, or having reason to know, that his license and his privilege of operating a motor vehicle in New York State and his privilege of obtaining a license issued by the Department of Motor Vehicles was revoked or suspended, and said revocation or suspension having been issued upon a violation of Section 1192 of the Vehicle and Traffic Law of the State of New York.
The second count of the indictment alleges that Quintana, at the aforementioned time and place, did operate a motor vehicle while in an intoxicated condition. At the time of his arrest, Quintana was allegedly observed swaying as he walked, his speech was slurred, his eyes were bloodshot and watery and his breath smelled strongly of alcoholic beverage.
According to a special note attached to the indictment issued by the Chenango County District Attorney's Office, Quintana was previously convicted of misdemeanor DWI on April 6, 2015, in Oxford Town Court.
• Kenneth E. T. Oefelein, 26, of Afton, was indicted on one felony charge. Oefelein was charged with one count of failure to register as a sex offender, a class E felony.
It is alleged that Oefelein, on or about a day during the month of February, 2016, did knowingly fail to register his Facebook account. Further, as of July 11, 2016, record of the Division of Criminal Justice Services indicated that the defendant had not registered said Facebook account with the sex offender unit.
All of the above are presumed innocent until found guilty in a court of law. They will appear in Chenango County Court at a later date.
