Man arrested following mva, authorities say subject’s BAC was more than twice legal limit

PRESTON - On Sept. 6, a Town of Norwich resident was arrested for driving while intoxicated, driving while intoxicated with BAC greater than .08 of one percent, and aggravated DWI for having a BAC greater than .18.
Members of the Chenango County Sheriff's Office arrested John P. Rutan, 62, after an investigation into a motor vehicle accident that occurred in the Town of McDonough. Deputy Lawrence located the suspected vehicle involved in the accident traveling in the Town of Preston. As the deputy approached the vehicle to conduct a traffic stop, the operator allegedly stopped on a side road to urinate. It was found that Rutan was the subject that the deputies were looking for and he was allegedly found to be operating the vehicle in an intoxicated condition.
Rutan was taken into custody without incident and was found to have a blood alcohol content two and a half times more than the legal limit. He was processed and released on an appearance ticket, and is scheduled to appear in the Town of Preston Court next Tuesday, Sept. 27, at 2 p.m.
The Chenango County District Attorney's Office was called for further information regarding the arrest, but The Evening Sun did not receive a return call as of press time.
