Man who allegedly threatened gun attack against Raymond company, demands trial over felony, terror charges
NORWICH – A Greene man requested a trial in Chenango County Court on Monday after being charged with making a terrorist threat and hearing he may have to pay $89,000 in restitution.
Andrew P. Riley, 48, of Greene, was charged with two counts of making a terrorist threat, a class D felony. Riley is facing 14 years in prison, along with three years of post-release supervision if convicted.
According to his indictment, on June 1, 2017, Riley called Raymond Corp. in Greene, New York and threatened to, "take his gun to the [business] and kill everybody."
The indictment states on June 6, 2017, another person overheard Riley saying he wanted to blow up the business.
Prosecutors are claiming the threat caused the company $89,193.25 in damages or lost revenue. Riley may have to pay that amount back as restitution if he is found guilty.
"We will be calling an expert in the trial," said Riley's defense attorney, Paul Battisti.
Battisti said his client was drinking alcohol at the time of the incident and suffered from alcohol induced amnesia, and had a history of alcohol abuse in the past.
He suggested that Riley wasn't in control of his actions after a certain amount of alcohol, but said the expert will go into greater detail during the trial.
According to Chenango County Judge Frank Revoir Jr. said Riley had an arrest history that included drinking and driving charges.
Assistant District Attorney Michael Ferrarese pointed out that Riley's attorney wasn't arguing against the threats being made against the business, only that they were insincerely stated.
"He's not negating the act, he's debating intent as an element, " said Ferrarese.
According to Revoir, Riley was offered a year in jail, or six months of incarceration followed by five years of probation as parts of a plea deal, but he rejected them.
"You understand that if you have a change of heart, the people don't have to continue to extend that offer," said Revoir.
Riley responded with a yes, and was told by Revoir that if he is found guilty on all counts, he faces 14 years in prison, with three years of post-release supervision.
