Woman sentenced to prison for arson, ordered to pay about $200k in damages

NORWICH – A Greene woman was sentenced on arson charges Friday and ordered to prison for burning down her own home.

Anna Santiago, 51, of Greene was convicted for third-degree arson on October 29 after jurors heard that on August 3, 2017, in the Town of Greene, Santiago intentionally set fire to her residence at 21 Chipmunk Lane.

She was sentenced to one to three years in prison on Friday after officials said they were disappointed that she wasn't taking responsibility for her actions. However, Santiago has said she is innocent and may appeal the charges.

According to expert testimony presented in the case, Santiago could have received up to $1 million dollars as part of an insurance claim her husband filed before his death, but only received $203,673.73 after her claim was denied.

Her attorney, Debra Gelson said she is planning on filing an appeal on behalf of Santiago after taking issue with several of the rulings that occurred during the trial.

Gelson also spoke on how proud she was of her client, and her ability to remain positive.

"Even though Ms. Santiago sits here as a convicted woman, one of the things I'm most proud of is while she's been incarcerated she has continued to live her positive lifestyle," said Gelson. "She's recently started a group in her pod called, 'New Beginnings,'" focused on improving lives."

Santiago also spoke at sentencing, apologizing to the court for the trial and discussing life behind bars.

"I'm sorry for being stubborn and not listening to you," she said. "I miss my life outside, and I never thought I'd end up here."

Her attorney requested the court consider releasing her without jail time on a certificate of physical limitations, but after being denied she said the minimum sentence of one to three years in prison would suffice.

Chenango County Judge Frank Revoir Jr., said while he did have the opportunity to sentence Santiago to a sentence that didn't include jail time, he was disturbed at the fact that she continued to maintain her innocence.

"You put all of those fire fighters at risk," he said. "They were trying to save your property without knowing you were the one who had set it on fire."

Revoir said throughout the trial Santiago was a, "sympathetic defendant," and that it was unlikely that anyone walked out of the courtroom hating her.

"We don't punish people for exercising their right to go to trial so you don't have to apologize," said Revoir. "However, I have no doubt you set your own house on fire."

Chenango County District Attorney Michael Ferrarese also commented on Santiago and said he was disappointed she continued to fail to take responsibility for her actions. He said regardless, he would agree to the minimum sentence of one to three years in prison.

Revoir sentenced Santiago to one to three years in prison, and ordered her to pay back $213,813.41 in restitution.

Outside of court, Santiago's attorney said an appeal will be filed on this case.

"This is going to be appealed," said Gelson. "Throughout the trial I found several evidentiary issues that need to be addressed."
