Father accused of assaulting baby that died considers deal

NORWICH – The man accused of causing the death of his 20-month-old child is scheduled to discuss accepting or rejecting a plea deal in Chenango County Court on Monday.

Devan A. Ellsworth, 28, of Norwich has been indicted for second-degree manslaughter, a C class felony, and criminally negligent homicide, a E class felony, after he allegedly struck his daughter on her face and caused a subdural hematoma, which prosecutors say led to her death.

The incident occurred at around 6 p.m. on August 26, following a 911 call. The Norwich Police and Fire Departments responded. According to police, upon arrival officers saw a 20-month-old with injuries to her face and head.

Officials said she was transported to Chenango Memorial Hospital and then moved to Upstate University Hospital in Syracuse, but ultimately she died in Upstate University Hospital the following day.

Former District Attorney Joseph McBride declined making any comment on the details of the case, saying it would be handled in court.

“Mr. Ellsworth will appear in court for his arraignment shortly and more discussions about the case will take place then. This case has been a tragedy for the community,” said McBride.

He said the investigation indicated Ellsworth was responsible for the 20-month-old girl's death. He added that Ellsworth was living in an apartment with the mother of his two twin daughters, one of whom was the victim.

Originally charged with felony assault, Ellsworth was then indicted for manslaughter after investigators received forensic results from state police and from the victim's autopsy.

Ellsworth, is on parole for a 2017 conviction for making meth in the city of Norwich and has remained in jail without bail as the state reviews his case.
