Grand jury indicts nine with felonies
NORWICH – Nine individuals were indicted by a Chenango County grand jury for felony crimes including burglary, criminal sale of a controlled substance, and rape.
• Jamie L. Whitmore, Jr., 23, of Norwich was indicted for first-degree rape, a class B felony, first-degree criminal sexual act, a class B felony, second-degree sexual abuse, a class A misdemeanor, and endangering the welfare of a child, a class A misdemeanor.
According to his indictment, on August 23 while in the City of Norwich, Whitmore had sexual intercourse with a six-year-old victim.
At his arraignment Whitmore was remanded on $25,000 cash bail, and District Attorney Michael Ferrarese said bail was needed to ensure he appeared to future court dates.
“The defendant faces 25 years in state prison,” said Ferrarese. “He poses a serious flight risk, and the people would ask that bail remain the same to ensure he appears at future court dates.”
11 days later, on December 31 2018 Whitmore was released on his own recognizance.
• Lukest J. Wahlberg, 20, of Columbus was indicted for two counts of first-degree rape, class B felonies.
The indictment states that Wahlberg raped a victim on February 15 in the Town of Columbus.
• Michael A. Wright, 25, of Norwich was indicted for first-degree rape, a class B felony, and first-degree criminal sexual act, a class B felony.
Allegedly, on February 10 in the City of Norwich, Wright raped a victim that was passed out from a combination of medication, alcohol, and drugs.
The indictment alleges that Wright did, “...engage in oral sexual conduct or anal sexual conduct with another person who is incapable of consent by reason of being physically helpless.”
• Matthew F. Jones, 32, of Greene was indicted for second-degree burglary, a class C felony, third-degree burglary, a class D felony, two counts of third-degree criminal possession of a weapon, class D felonies, and fourth-degree grand larceny, a class E felony.
According to his indictment, on February 14 and February 18 Jones broke into residences in the Town and Village of Greene.
“...on or about February 14, 2019, in the Town of Greene, County of Chenango and State of New York, [Jones] did knowingly enter and remain unlawfully in a building with intent to commit a crime,” states the indictment, “...the defendant did commit the crime of larceny therein by stealing a .12 gauge Remington shotgun, 6 boxes of .308 ammunition, 5 boxes of 12 gauge ammunition, an ammo can with 5.56 ammunition, a Blue Sentry safe containing personal papers, a Skunk two-throttle body, and $800.00 In United States currency from within.”
The indictment alleges that Jones had a loaded .45 caliber Springfield Armory handgun and a .25 caliber Guardian pistol with scratched off serial numbers. It adds that the value of the allegedly stolen goods is approximately $2,750.
Allegedly four days later on February 18, Jones broke into a business in the Village of Greene and stole various items from inside.
It states that Jones entered the store by breaking a window, and then stole apartment keys, a pocket knife, and a flashlight.
• Shanon D. Lane, 32, of location was indicted for third-degree criminal mischief, a class E felony, and fourth-degree criminal mischief, a class A misdemeanor.
Allegedly, Lane intentionally damaged a cell door and two mirrors in the booking area of the Chenango County Correctional Facility by peeling off paint using his restraints.
• Jason J. Babcock, 52, of Sidney was indicted for fourth-degree criminal possession of a controlled substance, a class C felony, and seventh-degree criminal possession of a controlled substance, a class A misdemeanor.
Babcock’s indictment states he had 4.541 grams of cocaine on his person on October 2, 2018 in the Town of Norwich.
• Amanda L. Vanhouten, 35, of Norwich was indicted for fifth-degree criminal sale of a controlled substance, a class D felony.
According to the indictment, during the month of January Vanhouten sold methamphetamine in the City of Norwich.
• Zestina T. Barnes, 25, of Norwich was indicted for first-degree criminal nuisance, a class E felony.
Allegedly, during the month of January Barnes maintained a residence in the City of Norwich where individuals gathered to sell methamphetamine.
“Further, the defendant did benefit monetarily and received methamphetamine for her personal use from the controlled substances transactions that took place at her residence,” states the indictment.
• Joseph M. Titsworth, 42, of South Plymouth was indicted for failure to register or verify as a sex offender, a class E felony.
According to the indictment, on January 11 in the Town of Plymouth Titsworth had failed to register a change of address with the New York State Sex Offender Unit within 10 days of moving.
