Man given another chance after ignoring court and testing positive for meth
NORWICH – A Greene man avoided prison time after testing positive for methamphetamine and telling court officials he accidentally got some powder on his finger and licked it off.
Joshua R. Backus, 21, of Greene was originally arrested at 12:02 a.m. on April 6, after Backus allegedly pushed two subjects, and left the scene. The subjects made a complaint to police.
While conducting an investigation into the complaint, troopers located Backus driving and pulled him over along Town Barn Road in Oxford. Police reported seizing cocaine from inside the vehicle.
He eventually pleaded guilty to fifth-degree criminal possession of a controlled substance in County Court, and according to Chenango County Court Judge Frank Revoir Jr., Backus was sentenced to receive treatment court, but he failed to appear for scheduled drug tests and court appointments.
The judge said this resulted in a warrant being issued for Backus and he was re-arrested for violating the terms of his release.
"After receiving information that he was in violation of the terms and conditions of his release, the court ordered a warrant for his arrest," said Revoir.
After police arrested Backus the court said he tested positive for methamphetamine. He denied using drugs.
"He told law enforcement, 'His cousin used meth, he got some powder on his finger, and he ended up licking it,'" said Revoir. "When he appeared in the drug treatment court for his violation, he appeared unconcerned, laughing throughout the proceeding."
He said even though there was a violation of his treatment court agreement, the court didn't plan on sending him to prison.
"Regardless of his behavior, I'm not going to shut the door yet," said Revoir.
