Troopers confirm death in Unadilla Motocross DWAI investigation
COLUMBUS – The Chenango County District Attorney's Office has yet to bring additional charges against a Utica man who ran over and killed a pedestrian on State Route 8 at the Unadilla Motocross event over the weekend.
On Friday, New York State Police arrested 31-year-old Eward D. Burnett of Utica on two felony charges of driving while ability impaired with a child 15 or under as the passenger, and a single felony charge of vehicular assault in the second degree.
Troopers are collaborating with the Chenango County District Attorney's Office to determine whether additional charges are warranted.
Police say the victim, 20-year-old Jonathan Mayzak of South Carolina, succumbed to his injuries shortly after 1:30 p.m. Sunday. An autopsy will be performed at the Onondaga County Medial Examiner's Office.
Troopers say they located the victim on the shoulder of State Route 8 on Friday. An off-duty Sidney Police Officer was on scene tending to the victim. Troopers then assisted with first aid until paramedics arrived.
The victim was transported by ambulance to St. Elizabeth’s Medical Center in critical condition.
Troopers found that Benett showed signs of being impaired at the time of the crash. He had three passengers with him; a 30-year-old female and two children, ages four and eight.
Burnett was arrested and arraigned in Columbus Town Court then remanded to the Chenago County Jail on $100,000 cash bail or $200,000 bond.
