Police: BB gun fired at pedestrians, meth and cocaine found in vehicle, no arrests made due to new law

NORWICH – On Wednesday night, the day New York State implemented its criminal justice reforms, three people were stopped in the City of Norwich after allegedly shooting pedestrians with a BB gun with felony levels of methamphetamine and cocaine in their vehicle.

Police said they were unable to release the names of the suspects because they were not charged with any crimes at that time.

The individuals were released while law enforcement awaits test results from the New York State Lab to comply with the state’s new discovery law.

Norwich Police Department Detective Sergeant Reuben Roach said Wednesday night at approximately 10 p.m. the Norwich Police Department received a telephone call from a person stating that there was a vehicle driving around the City of Norwich firing a BB gun at people on the street.

Roach said Norwich police officers were able to make a traffic stop on the vehicle. He said during the stop police discovered enough meth and cocaine, that was packaged for sale, to warrant multiple felonies.

“In compliance with the new laws that took effect as of January 1, no criminal charges were filed at that time,” said Roach. “We’re hoping that charges will be filed in the future once the New York State Police Crime Lab can return the results.”

According to a statement from New York State Governor Andrew Cuomo’s Office, these criminal justice updates deliver, “...sweeping criminal justice reforms by eliminating cash bail for misdemeanors and non-violent offenses, ensuring the right to a speedy trial, and transforming the discovery process.”

The office said prosecutors must now provide defense with discoverable information and materials within 15 days of arraignment.

The reforms have also drawn widespread criticism from a number of state and law enforcement officials.

Roach said that arrests couldn’t be made on Wednesday night because of the restrictions that the new discovery laws have put into place.

“The results needed to be tested within 15 days, and unfortunately the crime lab needs more time than that,” Roach said. “If it wasn’t tested and provided to defense in that time frame, the charges may have been dropped in court.”

He said at this time the investigation is ongoing, and charges may be filed when the results the police sent out are returned. He added that in the meantime the individuals were released in compliance with the new laws.
