Woman charged with murder after allegedly shooting Sherburne man

SHERBURNE – Law enforcement have charged a Johnson City woman with murder following a shots fired call in the Village of Sherburne Monday afternoon.
According to Chenango County Sheriff’s Office Lieutenant Joshua Gould, at 11:11 a.m. on Monday law enforcement responded to the scene of 7 Gould Drive in the Village of Sherburne and found John Ryan, 39, of Sherburne dead.
Police recovered a shotgun and said Ryan was killed by Kelly Gillett, 36, of Johnson City.
Gould said the Chenango County Sheriff’s Office Uniformed Division and NYS Encon responded to the call and later charged Gillett with second-degree murder.
Chenango County First Assistant District Attorney Christine Rudy said someone is charged with second-degree murder when they intend to cause the death of another person. She said someone can only be charged with first-degree murder in very specific circumstances, and the allegations of the crime didn’t meet that threshold.
Gould added that Gillet was remanded to the Chenango County Correctional Facility without bail.
He said an investigation determined that Ryan died from gunshot wounds, and was dead upon police’s arrival. He added that a shotgun was collected as evidence in the case, and that the incident occurred inside the Gould Drive residence.
“At this point in time we can’t release any additional information,” said Gould. “The crime is still under investigation, and we’re asking those who have information about the incident to reach out to us.”
He said the Sheriff’s Office investigative and crime scene staff members were assisted by the New York State Police Forensic Investigative Unit, the New York State Environmental Conservation Officers, Sherburne Police Department, Sherburne Emergency Medical Services, Chenango County District Attorney’s Office and Chenango County Medical Examiner.
He added following Gillett’s arrest, she was arraigned in Sherburne Village Court and remanded to the Chenango County Correctional Facility without bail.
“We’d ask that anyone with information reach out to Sgt.Gary Miller at 337-1935,” said Gould.
When asked about how law enforcement were able to make an arrest shortly after the incident even with the New York State Criminal Justice System reforms, Gould said there were specific circumstances in this case which made it possible.
Gould added that the investigation is ongoing, and more details may be released in the future.
