Sex and alcohol felonies fill grand jury’s indictments

NORWICH – Wednesday, the Chenango County grand jury indicted three individuals with sex crimes, two of them violent assaults and one alleged pedophilia.
Two repeat offenders also were indicted for driving under the influence of alcohol with children in their vehicles.
Here’s a list of those indicted Wednesday:
• Twenty-six-year-old Lee Anthony Warner of Sherburne was indicted with first-degree criminal sexual act, a class B felony, and second-degree assault, a class D felony.
The Chenango County Sheriff’s Office arrested Warner Sept. 10 after he allegedly sexually assaulted his female roommate. The indictment claimed Warner was “using forcible compulsion by punching (the victim) and holding her down,” causing physical injury to the woman.
Lt. James E. Lloyd said the residence was not known to police for past domestic violence incidents, but referred to the crime as a domestic incident because the defendant and the victim had a past personal relationship.
“She was taken to Chenango Memorial Hospital following the attack and treated for her injuries there. She was released later that day.”
Warner was arraigned in Sherburne Village Court and remanded to the Chenango County jail on $25,000 cash bail.
• Billy J. McGinnis, 26, of Guilford, was indicted for first-degree attempted rape, a C class felony, forcible touching and third degree assault, both misdemeanors, after allegedly attacking a woman in the Town of Guilford area Sept. 5.
McGinnis was arraigned and remanded to the Chenango County Correctional Facility on $25,000 bail.
• Michael A. Demueth, 33, of Norwich, was indicted on three counts of third degree rape, an E class felony, after allegedly having sexual intercourse with a 15-year-old girl on three different occasions between March and April of 2008 in the Town of Oxford along Bradley Hill Road. He was also charged with misdemeanor endangering the welfare of a child.
• Kelly F. Cordner, 39, was indicted for aggravated driving while intoxicate, a D felony, first degree aggravated unlicensed operation of a motor vehicle and endangering the welfare of a child.
Police pulled over Cordner at 3:30 a.m. July 10 on Midland Road in the Town of Afton with two children in his car under the age of 10; he was allegedly under the influence of alcohol.
Cordner already had a suspended license from a prior DWI conviction in Chenango County Court and another from Delaware County.
Police at the scene reported that he blew a .23 on their alcohol sensors, nearly three times the legal limit of .08.
• 28-year-old Gary J. Sheehan Jr. was indicted for driving while intoxicated and endangering the welfare of a child. Allegedly at 11:30 p.m., Aug. 9, along County Road 9 in the Town of Greene, Sheehan was pulled over under the influence of alcohol and had a five-year-old in the passenger’s seat.
Sheehan was convicted on a prior DWI March 21, 2007 in Town of Kirkwood Court, Broome County.
At grand jury proceedings, the District Attorney’s office presents evidence against those they wish to prosecute and the jury decides if there is enough reasonable cause to charge a person.
Jurors serve at roughly three-month intervals and typically convene once a month.
