New Berlin man charged with felony domestic abuse charge
MORRIS – New York State Police at Oneonta recently arrested Kyle R. Johnson, 27, of New Berlin on May 1, 2016.
Johnson has been charged with aggravated family offense, a class E felony; assault in the third degree, a misdemeanor; endangering the welfare of a child, a misdemeanor; criminal obstruction of breathing or blood circulation, a misdemeanor; unlawful imprisonment in the second degree, a misdemeanor; and criminal mischief in the fourth degree, a misdemeanor.
The arrest allegedly occurred following a Otsego County 911 call reporting a dispute on County Route 18, in the Town of Morris.
Members of the New York State Police at Oneonta responded to the scene and following an investigation, determined that Johnson had choked and punched his wife in front of their children. Johnson allegedly would also not allow his wife to leave or call 911 during the dispute.
According to authorities, the felony charge occurred due to Johnson having a prior conviction for criminal obstruction of breathing or blood circulation within the last five years, and will now be charged with the same crime again.
Johnson was arraigned in the Town of Laurens Court and was remanded to the Otsego County jail in lieu of $10,000 cash bail or $20,000 property bond.
Johnson will appear next in the Town of Morris on May 4, 2016.
