Man accused of possessing child porn seeks trial to prove his innocence
NORWICH – A man facing child porn charges appeared in Chenango County Court on Monday, claimed his innocence and is requesting a trial.
Dirk M. Smith, 39, of Norwich, was arrested on October 26, 2017 in the town of Bainbridge and charged with possessing a sexual performance of a child, a class E felony, and resisting arrest, a class A misdemeanor.
THe defense rhas refused a plea offer by the District Attorney's Office, and Smith's attorney, Assistant Public Defender Zachary Wentworth, said his client would prefer to go to trial and clear his name.
"He's maintaining his innocence in this matter, and he is seeking his day in court," said Wentworth.
According to Chenango County Judge Frank Revoir Jr., Smith could receive up to four years in prison, for the possession charge, and another year for the resisting arrest charge.
Revoir asked Smith if he understood his possible prison time and that the prosecution could revoke their plea offer, and Smith responded yes.
Assistant District Attorney Laura Parker said the prosecution has four witnesses to call, and they are ready to testify in the case.
The trial date is scheduled for Monday, July 23.
